Secret detention, involving the denial or concealment of a person’s detention, whereabouts or fate has the inherent consequence of placing the person outside the protection of the law.

Subsection (d) provides that the Law does not justify non-disclosure of information except as provided for in the Law and that it is not authority to withhold information from Congress.

7.3 The Committee recalls the definition of enforced disappearance set forth in article 2 of the International Convention for the Protection of All Persons from Enforced Disappearance of 20 December 2006, which states: “For the purposes of this Convention, ‘enforced disappearance’ is considered to be the arrest, detention, abduction or any other form of deprivation of liberty by agents of the State or by persons or groups of persons acting with the authorization, support or acquiescence of the State, followed by a refusal to acknowledge the deprivation of liberty or by concealment of the fate or whereabouts of the disappeared person, which place such a person outside the protection of the law.

3.2 Kamel Djebrouni’s arrest by Government officials was followed by a refusal to admit that he had been deprived of liberty or to say what had happened to him.

I fail to understand the fervour of the opposition to the Security Council’s mandating and receiving a report on the findings of such investigations, unless there is something to be hidden from this Council.

We are aware that, in the Andean highlands, there are heads of household who do not allow children who have a mild or moderate disability to work.

5.3.1 We do not engage in or condone behavior that is designed to deceive others, including but not limited to, making misleading or false statements, stating half-truths, providing information out of context or withholding information that, if known, would render our statements as misleading or incomplete.
