Taking into account the aforementioned geographical location of the diamond areas and the Group’s overall view that the basic economic structure of the former Forces nouvelles, in particular in those areas that continue to be under the influence of zone commanders, remains somewhat intact, it can be contemplated that this structure, or elements of this structure, continue to benefit from diamond revenues, as do non-Ivorian individuals and entities who remain unlicensed.

These other contractual rights might include, for example: (a) the licensor’s right to compel the licensee to advertise the licensed intellectual property or product with respect to which the intellectual property is used; (b) the licensor’s right to compel the licensee to market the licensed intellectual property only in a particular manner; and (c) the licensor’s right to terminate the licence agreement on account of the licensee’s breach.

The law also prohibits the production, copying, storage, presentation, glorification or dissemination of promotional material, symbols or features which incite, encourage or spread hatred or intolerance against free affiliations of citizens, racial, national or religious hatred or intolerance, propagate or justify neo-Nazi and fascist ideas and organizations or jeopardize the public order in some other way, as well as the production, copying, storage, presentation or dissemination or any other form of using symbols promoting or justifying the ideas, activities or actions of persons convicted of war crimes.

This concentration of effort has also enabled UNESCO to regain a degree of international “leadership” in these five fields, as is witnessed by, inter alia: the recognition (gradual and difficult, but real) of its role of general coordinator of the Education for All movement, after Dakar (April 2000); recognition, too, of its primary responsibility for the evaluation and monitoring of the state of water resources worldwide; its role as “lead agency” for all questions relating to bioethics within the United Nations system; its role of principal authority, in both normative and operational terms (in Afghanistan, Iraq and elsewhere), with respect to the preservation of the cultural heritage; lastly, its role as the unique institution promoting dialogue, between government and civil society, in all matters relating to the defence of freedom of expression and the organization of knowledge societies.

To the extent that these are deliberate actions, it is necessary to thoroughly review the reasons why the training received in international humanitarian law is being ignored, and why soldiers on the ground do not comply with directives issued by the Ministry and the army command.

If the complainants constituted a danger to the security of the State party, the authorities should have charged them with a crime and tried them in their courts.

As to the assumption that Alexander Blücher would not have been entitled to claim restitution under the Land Act because he was allegedly not a Czech citizen and therefore would not have fulfilled the criteria under the Land Act, the “logic” behind this reasoning is based on a hypothetical application of a discriminatory citizenship requirement to the original owner as if he were the applicant under the Act.

This is positive for a number of reasons: firstly the scale and speed of communication, to a degree, creates accountability – it is harder now to get away with atrocities unnoticed; secondly, it enables us to communicate without having to travel, reducing our impact on the environment; thirdly, it has the potential to dispel the ignorance and misunderstanding that we might have about other cultures – this is key to our survival’.

The lack of clear requirements and the use of phrases such as “to the extent possible” provided a form of protection for those countries that had traditionally used technology without any restrictions or controls and, in some cases, without regard for human life or the environment.

The Special Envoy also informed the Security Council that owing to its fragility, the situation would continue to require close monitoring and that his office in Nairobi would therefore require not only some capacity to continue monitoring further progress for a limited period, but also some form of mechanism to carry forward the monitoring and follow-up thereafter.

Clause 11 of the Bill proposes to add sections 67(2A) and 67(2B) to the effect that at the end of the trial of an election petition that relates to the inclusion of the name of a person in, or the exclusion of the name of a person from a precedence list, CFI must determine whether the name is to be included in the list, and at the end of the trial of an election petition that relates to the ranking of a person on a precedence list, CFI must determine whether the ranking of the person on the list is correct and, if not correct, what is the correct ranking.

Section 6(2) of the Ordinance provides that where a person fails to pay the fixed penalty for the scheduled offence specified in the notice given under section 3(1) within the time specified or refuses to accept the notice, the specified Authority shall serve on the person a notice in the prescribed form (a) demanding payment of the fixed penalty for the scheduled offence; (b) informing the person that if he wishes to dispute liability for the offence he should notify the Authority in writing; and (c) stating that the payment or notification shall be made within 10 days from the date of the notice so served.

At present, if a researcher isolates a gene and is granted a patent, for example, for the use of that gene as a diagnostic for a particular disease, depending upon the precise wording of the claim and the approach that the local law takes to interpretation of the patent, she may be able to assert rights over all uses of that gene, including those as yet undiscovered.

Argentina has witnessed the constructive efforts pursued by Japan on this issue, having participated in 2006 in the drafting of the presidential note contained in document S/2006/507, a legal instrument that has become the document of reference for this topic, filling, to some extent, the gap in the Security Council’s rules of procedures.
