The Ministers recognized the importance of Strengthening the conservation and sustainable use of biological diversity and the establishment of an a fair and just international regime on access and benefit sharing that respect the sovereign rights, of States over their natural resources and promotes the fair and equitable benefit sharing from the utilization of genetic resources and associated traditional knowledge in the framework of the Convention on Biological Diversity and other related international instruments.

Notably, delegations highlighted the following practical measures: the promotion of marine scientific research; the development of codes of conduct for research activities; environmental impact assessments, including the development of guidance on assessments of impacts on marine genetic resources within the general environmental impact assessment process; the establishment of mechanisms for cooperation and the sharing of information and knowledge resulting from research on marine genetic resources, including by increasing the participation of researchers from developing countries in relevant research projects; the establishment of marine protected areas; discussions on practical options forbenefit-sharing, including options for facilitating access to samples; and consideration of the intellectual property aspects of marine genetic resources beyond areas of national jurisdiction (A/65/68, para. 73).

Three additional areas of common interest, for which further cooperation could be mutually beneficial in overcoming the middle-income trap, were inclusive growth, green growth and knowledge-based growth.

This trend of general expansion bodes well for the satellite industry both directly in the DTH market and indirectly in the distribution of content to these new platforms.

Special and differential treatment and policy flexibility for LDCs need to be made operational according to a given country’s stage of development (rather than limiting it by time) within the World Trade Organization and regional and bilateral agreements, so that LDCs can adopt development strategies that reflect their specific needs and opportunities.

The Conference Recommendations included a request to ensure the equal participation of women and women’s organizations in decision-making processes related to biodiversity, and also that the Gender Plan of Action of the CBD be fully implemented that measures be taken to ensure gender equality is mainstreamed, and that appropriate measures be taken to guarantee thatthe benefits derived from access to biodiversity be shared.

In relation to question 3 (a), the provisions quoted above (see para. 12 above) in several of Australia’s delimitation agreements make it clear that for any transboundary petroleum resource found, the two parties are to seek to reach agreement on the manner in which the resource is to be most effectively exploited and on the equitable sharing of the benefits arising from such exploitation.
