Accordingly States which had explicitly accepted the continued applicability of a treaty, or which because of their behaviour or conduct were to be deemed to have acquiesced to the continuity of the treaty, would be deprived of the right to terminate, withdraw from or suspend the operation of the treaty.

Under the statute and the Rules of Procedure and Evidence, the absentee retains, however, some fundamental rights: (a) he or she may appoint defence counsel of his or her choosing; (b) he or she may terminate his or her absence and appear in court (rule 108); (c) if he or she has not appointed counsel of his or her choosing, once the trial is over, he or she may ask for a retrial (rule 109); (d) if he or she has appointed defence counsel of his or her choosing, he or she has the right to appeal against the judgement of the Trial Chamber.

The same situation could occur where: (a) the grantor seeks to acquire an exclusive licence, which is treated as a transfer of the intellectual property itself; (b) a licensor would be willing to grant a non-exclusive licence on credit if it is granted additional protection beyond that which it would get by simply terminating the licence agreement; (c) a licensee, as a sub-licensor, is willing to grant a non-exclusive sublicence only if it can acquire a security right in the rights of a sub-licensee and any rights to payment of sub-royalties payable to the sub-licensee by a sub-sub-licensee; and (d) the acquisition financing is provided not by the owner as transferor or as licensor, nor by the licensee as sub-licensor, but by a third-party lender.

(d) Where proposals are under consideration concerning the appointment (including fixing or varying the terms of or terminating the appointment) of two or more Directors to offices or employments with the Company or any company in which the Company is interested, such proposals shall be divided and considered in relation to each Director separately and in such case each of the Directors concerned (if not prohibited from voting under paragraph (c)) shall be entitled to vote (and be counted in the quorum) in respect of each resolution except that concerning his own appointment.

In contrast, as stated above, the rules governing trials in the absence of the accused, as provided by the Tribunal’s statute and Rules of Procedure and Evidence, in addition to making the procedure exceptional, confer a set of important rights on the absent accused, in particular, the right to retrial if he or she is apprised of the default proceedings or terminates his or her hiding, as well as ( a fortiori ) the right of appeal.

The Company may terminate each appointment by immediate notice and there are no special arrangements or entitlements on termination.

The Board was concerned that if the function of creating, modifying and terminating users, performing system maintenance and programming, as well as adding/deleting tables and fields to the database, were those of one person there was a risk that errors and fraudulent activities may not be independently detected and prevented in a timely manner by internal controls.

The Directors-General may terminate observer status if an Organization no longer meets the criteria that applied at the time it was granted observer status, or for reasons of exceptional nature, in accordance with the procedures set out in this section.

Upon an Event of Default, the non-defaulting shareholder of JVCo shall have the right, exercisable upon delivery of a notice to the Defaulting Shareholder (the ‘‘Default Notice’’), to (i) terminate the Shareholders Agreement; and (ii) in the event (a) Philips is the defaulting shareholder, to call on Philips to sell and transfer to MMD (and Philips shall be obliged to thus sell and transfer) the shares of JVCo held by Philips (‘‘Philips Default Put Option’’) against payment by MMD of the Default Option Price (as defined below); and (b) MMD is the defaulting shareholder, to sell and transfer to MMD (and MMD shall be obliged to thus purchase and accept) the shares of JVCo held by Philips against payment by MMD of the Default Option Price (as defined below).

4.47 We may, at any time, without giving notice or reason suspend or terminate all or any of the Internet/Phone Banking Services or their use by you and, where applicable, the Authorized User.

In the event that the conditions are not fulfilled or waived (as the case may be) in full or if the JV Business Licence is not issued to GP Corp. within nine (9) months from the signing date of the Capital Increase Contract (or such later date as Alliance BMP may determine and notify the Company in writing), any party to the Capital Increase Contract shall have the right to terminate the same by giving written notice to the other parties, in which case the Capital Increase shall not proceed.

The insurance cover of persons for whom social tax is paid by the state or local authority begins from the date of making the entry on the commencement of insurance cover, and the insurance cover terminates one month after termination of the obligation of the state or local authority to pay social tax for the person.

These other contractual rights might include, for example: (a) the licensor’s right to compel the licensee to advertise the licensed intellectual property or product with respect to which the intellectual property is used; (b) the licensor’s right to compel the licensee to market the licensed intellectual property only in a particular manner; and (c) the licensor’s right to terminate the licence agreement on account of the licensee’s breach.

If the Grantee (whether he is an employee of the Group or not) or his associate (i) commits any breach of any contract entered into between the Grantee or his associate on the one part and the Group or any Invested Entity or the Controlling Shareholder or any of their respective subsidiaries on the other part; or (ii) appears either to be unable to pay or to have no reasonable prospect of being able to pay his or its debts or becomes insolvent or is subject to any liquidation or analogous proceedings or makes any arrangements or composition with his or its creditors generally; or (iii) is convicted of any criminal offence involving his or its integrity or honesty, the right to exercise all outstanding Options held by him or it shall thereupon terminate immediately.

Either of those options would create problems in the management of the project, but the assistant director of Coteba acknowledged that, given the closeness of the architectural and engineering team to the companies working on the site, it would be more complicated for UNESCO to terminate the team’s contract, rather than that of the Assistant to the Contracting Authority.

Option 2 represents an elaboration of option 1, including the establishment of an escrow account into which all payments and revenues from the mining sector would be deposited, until the Security Council decides to terminate the measures imposed in resolution 2023 (2011).

Seagate has the right to terminate your use of this Site, or any portion of this Site, with or without notice, at its sole discretion, for any reason or no reason at all, including, but not limited to, if Seagate determines (at its sole discretion) that your use of or conduct on or related to this Site (i) violates these Terms or any additional terms and conditions, (ii) is harmful to Seagate, its customers or vendors, another user or any other party, or (iii) violates applicable law.

The present Agreement shall be valid for six years, and may be renewed by mutual written agreement for similar successive periods, on the understanding that either Party has the right to terminate it upon giving twelve months’ notice in writing to the other Party.

In the case where creation by the licensee/sub-licensor of a security right in its right to payment of royalties owed by its sub-licensee constitutes a breach of an initial or intervening licence agreement, the licensor would retain all its contractual rights under the licence agreement, including the right to terminate that agreement, and the secured creditor of the licensee/sub-licensor would also retain its right to collect sub-royalties, at least, as long as the licensor did not terminate the licence agreement.
