These include: a deep-sea port being constructed on the Indian Ocean near the Rakhine State capital of Sittwe, and parallel road, high-speed rail, and oil and natural gas pipelines that will create an energy and trade corridor to China’s landlocked south west; the Kaladan multi-modal project that will create a transportation corridor between the Indian Ocean and India’s eastern seaboard and its landlocked north east; and the Dawei Development Project which, if completed according to plan, would include a large industrial estate and modern deep-sea port in the south, with road and rail links for transhipment of goods to Thailand and on to Vietnam, cutting several days off the sea route through the Straits of Malacca.

President, as the complaints about unscrupulous business practices in pay television, telecommunications and Internet services have been on the rise in recent years, we urge the Government to review the existing mechanism, strengthen the regulation of the business practices of providers of such services, examine the extension of section 7M of the Telecommunications Ordinance, which regulates misleading or deceptive conduct of telecommunications operators, to cover pay television, and introduce a cooling-off period and standard terms in the contracts, so as to safeguard the rights and interests of consumers.

To demonstrate the "professional service" image of the new governing team, the DAB urges the SAR Government to expeditiously study the extension of section 7M of the Telecommunications Ordinance, which regulates misleading or deceptive practices by telecommunications service operators, to cover pay television and introduce a cooling-off period, a procedure for contract verification and standard terms in contract, with a view to preventing the proliferation of unscrupulous sales activities in the telecommunications and broadcasting industries, and only in this way can consumer interests be effectively protected.

The Section would be headed by a Chief Property Management Officer (P-4), the incumbent of which would report to the Chief of Integrated Support Services and would be responsible for: the management and maintenance of the Mission’s electronic assets control system; inventory management and the reduction of inventory levels; the disposal of written-off assets; the provision of specialist inventory and supply-chain management advice to self-accounting units; the continual review of store-holder inventories at all levels within the Mission; the modernization of warehousing standards and practices; reduction of inventory processing times; the collection, collation and analysis of stock holdings and stock consumption data; maintaining databases; and conducting contingent-owned equipment arrival and operational readiness as well as periodical and repatriation inspections and verifications.

In the Secretary-General’s seventh annual progress report (A/64/346), he indicated that, since the issuance of the previous report (A/63/477), the capital master plan project had transitioned from the design phase work to actual construction activity and he outlined the progress that has been made with respect to design work and the construction of the temporary North Lawn Building, as well as the relocation of staff to on-site and off-site swing spaces.

The Security Council welcomes the report of the Secretary-General (S/2010/394), as requested by its resolution 1918 (2010), on possible options to further the aim of prosecuting and imprisoning persons responsible for acts of piracy and armed robbery at sea off the coast of Somalia, including, in particular, options for creating special domestic chambers possibly with international components, a regional tribunal or an international tribunal and corresponding imprisonment arrangements, taking into account the work of the Contact Group on Piracy off the Coast of Somalia (CGPCS), the existing practice in establishing international and mixed tribunals, and the time and resources necessary to achieve and sustain substantive results.

Those members who were opposed to the extension of cooling-off arrangements to all products and services took the view that cooling-off period would not be applicable to every industry, and that it might slow down economic activities and growth, or even lower the competitiveness and creativity of the market.

It should be recalled in this context that the introduction of a modern HR management information system has been a major challenge across the entire United Nations system with differing approaches ranging from internally developed systems to “off-the-shelf” software packages.

Any general meeting sanctioning a dividend may make a call on the members of such amount as the meeting fixes, but so that the call on each member shall not exceed the dividend payable to him, and so that the call shall be made payable at the same time as the dividend, and the dividend may, if so arranged between the Company and the member, be set off against the call.

(e) The net estimated staff assessment income of 30,474,500 dollars, comprising the amount of 29,685,000 dollars for the financial period from 1 July 2011 to 30 June 2012 and the increase of 789,500 dollars in respect of the financial period ended 30 June 2010, to be set off against the balance referred to in subparagraph (d) above, to be prorated among the budgets of the individual active peacekeeping operations.

Management will increase the depreciation where useful lives are less than previously estimated lives, or it will write-off or write-down technically obsolete or non-strategic assets that have been abandoned or sold.

These include (a) rising and changing patterns of consumption in fast-growing and large developing countries such as China and India; (b) the possibly increasing trade-off between biofuels and food; and (c) the unfolding effects of climate change.

Several elements remained to be agreed, including the cut-off date and eligibility of swing plants, and the Sub-group had agreed to continue consideration of the issue at its next meeting.

Following the kick-off meeting and the feasibility study conducted to define the configuration of researchers at national, regional and international levels, as well as their needs for VL services, equipment and connectivity, the initial policy and strategic framework was defined.

Given that some Members wanted to discuss IS as part of a larger package on HCFC policy, the Executive Committee agreed to refer consideration of IS to the contact group convened under agenda item 9(b), “Analysis of new approaches on second-stage conversions, determination of cut-off date and other outstanding HCFC policy issues (decision 57/34)”.

The Commission will have before it for its consideration the report of the Executive Director on the implementation of Commission resolution 19/6, in which it requested UNODC to brief Member States on a regular basis on technical assistance provided to the Member States concerned and on the administration of the Trust Fund to Support Initiatives of States Countering Piracy off the Coast of Somalia, and encouraged Member States and other donors to provide extrabudgetary resources to support the work of UNODC to assist Member States in countering maritime piracy off the coast of Somalia (E/CN.15/2011/18).

(b) The respondent has failed to communicate its response to the notice of arbitration or its statement of defence, the arbitral tribunal shall order that the proceedings continue, without treating such failure in itself as an admission of the claimant’s allegations; the provisions of this subparagraph also apply to a claimant’s failure to submit a defence to a counterclaim or to a claim for the purpose of a set-off.

(B) All instructions and Transactions relating to any joint Account or (as the case may be) any Service, in the event of the death, or mental and/or other incapacity of or the occurrence of an Insolvency Event in relation to any one or more of the joint Account holder shall be subject to any claim or objection of relevant authority and shall be without prejudice to any right which we may have arising out of any lien, charge, pledge, set-off, claim, counterclaim or otherwise whatsoever or any step or legal proceedings which we may in our absolute discretion deem desirable to take in view of any claim by any person other than the survivors, executors, administrators of the deceased.

In his report, Jack Lang, Special Adviser to the Secretary-General on Legal Issues Related to Piracy off the Coast of Somalia, proposed the establishment of an extraterritorial Somali anti-piracy court in a third State in the region to act as a focal point for regional and international support to help strengthen the rule of law in Somalia, as a swift and inexpensive measure if located within the premises of the International Criminal Tribunal for Rwanda in Arusha, United Republic of Tanzania (see S/2011/30, annex).

Collective termination of employment contracts means termination of the employment or service relationship due to the liquidation of legal persons, including undertakings, administrative agencies, or agency administered by an administrative agency; termination of the employment or service relationship due to the lay-off of employees; termination of contracts of employment due to the termination of work of an employer who is a natural person.

We believe that the report (S/2012/50) of the Secretary-General demonstrates that the experts of UNODC, UNDP, the Contact Group on Piracy off the Coast of Somalia and other stakeholders understand clearly the problems and needs with respect to piracy prosecutions and how best to address those needs.

This time, we are seeking the implementation of the programme of work or of any other proposal that would allow the Conference to begin negotiations on a fissile material cut-off treaty in accordance with the Shannon mandate.

In some countries, police also carry out killings while off duty, whether for “vigilante” reasons, for profit, or as part of a well-organized militia or business enterprise.

With regard to the future international treaty negotiations, Croatia shares the opinion of its European partners on the need to convene as soon as possible negotiations on a fissile material cut-off treaty in the Conference on Disarmament in Geneva.
