Regarding funding support for the arts groups, members in generally considered that the Administration should (a) ensure a reasonable and fair distribution of funding resources amongst arts groups; (b) review the existing mode of subsidy for the major performing arts groups to avoid stifling the development of non-subvented commercial arts groups; (c) provide more funding for the support of small and medium sized arts groups and budding artists; (d) explore means to minimize staffing and administrative expenses in the operation of arts programmes so that the savings could be re-allocated to the use of arts development; (e) examine the effectiveness of the current funding policy in achieving the policy goals, such as encouraging diversified and balanced development of arts and culture; and (f) consider increasing its overall allocation of funding for culture and the arts, given the imminent need to achieve the vision of the West Kowloon Culture District project.

(B) If any member shall surrender for cancellation a share certificate representing shares held by him and request the Company to issue in lieu two or more share certificates representing such shares in such proportions as he may specify, the Board may, if it thinks fit, comply with such request subject to the payment of such sum (not exceeding, in the case of any share capital listed on a stock exchange in Hong Kong, the maximum amount prescribed or permitted from time to time by such stock exchange, and, in the case of any other share capital, such sum in such currency as the Board may from time to time determine to be reasonable in the territory in which the relevant register is situate, or otherwise in each case such other sum as the Board may from time to time determine) for every certificate after the first, as the Board shall from time to time determine.

Portuguese law guaranteed the basic human rights of all migrant workers and members of their families, regardless of their status, such as access to health services and education.

To every such separate general meeting the provisions of these Bye-laws relating to general meetings shall mutatis mutandis apply, but so that the necessary quorum shall be not less than two persons holding or representing by proxy (or, in the case of a member being a corporation, as the duly authorised representative of such corporation) at least one-third in nominal value of the issued shares of that class, and at an adjourned meeting not less than two persons holding or representing by proxy (or, in the case of a member being a corporation, as the duly authorised representative of such corporation) shares of that class, and that any holder of shares of the class present in person or by proxy (or, in the case of a member being a corporation, as the duly authorised representative of such corporation) may demand a poll.

The AC may request any officer or employee of the Company or the Company’s outside counsel or IAs to attend a meeting of the AC or to meet with any members of, or consultants to, the AC.

At its sixty-third session, the General Assembly took note of the appointment by the Secretary-General of a new Coordinator for Multilingualism; requested the Secretary-General to ensure equal treatment for all language services and effective multilingual communication among representatives of Member States, including through simultaneous distribution of documents in all official languages; requested the Department of Public Information to improve actions taken to achieve parity among the six official languages on the United Nations website; and requested the Secretary-General to submit to it at its sixty-fifth session a comprehensive report on the full implementation of its resolutions on multilingualism (resolution 63/306).

Each of the 13 Occupational Group Managers would continue the responsibilities for reviewing applications, identifying candidates for further assessment by subject matter experts, that is, expert panels, serving as Secretary for the expert panel under his or her purview and consolidating findings and interview reports from the panel for presentation to the Field Central Review Bodies, monitoring incumbency rates in the field operations for positions in his or her occupational group, managing his or her assigned roster, developing shortlists for programme managers in the field operations and determining when outreach activities should be conducted to address gaps in the roster, especially in gender and geographic representation, and determining the mobility opportunities for staff members currently serving in the field so as to rotate staff among relevant duty stations.

Assistance focuses on (a) establishing legal and policy frameworks consistent with international standards and norms; (b) strengthening the capacity of domestic institutions, in particular anti-corruption bodies and criminal justice institutions, to effectively prevent and control corruption in an integrated and coordinated way; (c) enhancing integrity, accountability and transparency in public and private sectors, including the management of public resources; (d) supporting relevant Government institutions in international cooperation and the recovery of assets at the domestic and international levels; (e) development of strategic and thematic partnerships with members of the international community and United Nations system to ensure coherency in the delivery of technical assistance; and (f) supporting the establishment of networks and platforms for policy dialogue and peer learning among Member States at the regional and international levels.

In the course of consultations with key constituencies (Member States, United Nations and academia) around the desirability of preparing a draft universal declaration of ethical principles in relation to climate change, it became clear that significant work is needed on the upstream clarification of basic ethical principles, including but not limited to climate change issues, along with downstream development of practical policy tools.

Several other Member States, while appreciating efforts to focus on cluster needs, questioned the results of strategic formulations undertaken in the recent past, many of which did not, in their opinion, reflect the full range of Member States’ needs or existing regional and subregional coordination mechanisms.

Members requested the Administration to ensure that: (a) the design of the Project should incorporate appropriate measures to maximize the use of renewable energy and promote energy efficiency; (b) the new facilities for the Project would be constructed further away from the riverside in order to provide a larger green area along the Shing Mun River for public enjoyment; (c) adequate sports and ancillary facilities and barrier-free access would be provided for disabled athletes in the redeveloped HKSI; and (d) training facilities for cycling would be provided following the demolition of the outdoor velodrome at Fo Tan venue to make way for the construction of the new multi-purpose building.

Chad also thanked the troika members, France, Slovenia and Zambia, and the secretariat for the work done.

Several challenges were encountered in the development of United Nations common country programmes: firstly, the domestic political situation, especially the growing concern over human rights issues and the government’s sensitivity on human rights, have made it very difficult to develop a common United Nations country programme for which UNCT and the government would have shared ownership; secondly, the profile of the donor community in Iran is very low and it has been very difficult to generate FIT resources and joint United Nations programming; and, thirdly, there is still reluctance and technical barriers among UNCT members to put together financial and human resources for joint activities.

This legislation provides for universal jurisdiction over any or a combination of the following: (a) grave breaches of the Geneva Conventions and Additional Protocol I thereto (primarily States members of the Commonwealth); (b) crimes specified under the Second Protocol to the 1954 Hague Convention and the International Convention for the Protection of All Persons from Enforced Disappearance (for example, Cyprus, Japan and the Netherlands); (c) other violations of international humanitarian law where no treaty requires universal jurisdiction, such as war crimes committed in non-international armed conflict (Belgium, Canada, New Zealand and the Philippines) and violations of treaties that either prohibit or regulate the use of certain weapons (South Africa); (d) the war crimes list contained in article 8 of the Rome Statute (Belgium, Canada, Germany, New Zealand and the United Kingdom).

His delegation requested the international community, as a matter of urgency: to take all the measures indicated in the conclusions and recommendations of the report contained in document A/64/339, including the imposition of sanctions on Israel if it failed to comply fully with all United Nations resolutions; to request Israel to allow the members of the Special Committee to enter the occupied territories in order to fulfil its mandate; and to require the Israeli Government to pay appropriate compensation for the damage it had inflicted on the Palestinians and the population of the occupied Syrian Golan.

(3) Where there are joint registered holders of any Share, any one of such persons may vote at any meting, either personally or by proxy, in respect of such Shares as if he is solely entitled thereto, but if more than one of such joint holders be present at any meeting personally or by proxy, that one the said persons so present whose name stands first in the register of members in respect of such Share shall alone be entitled to vote in respect thereof.

The representative of Turkey underlined the following points: (a) the organization, Centre Europe-tiers monde had been failing to adhere to the basic principles of the Charter of the United Nations and the basic requirements set out in Council resolution 1996/31 by disrespecting the territorial integrity and political unity of Turkey; (b) the organization had been undertaking unsubstantiated and politically motivated allegations against Turkey; (c) the organization had been inciting and condoning acts of terrorism against States Members of the United Nations, which is prohibited under international law; (d) the organization had become a propaganda vehicle of the terrorist organization PKK/Kongra-Gel; and (e) the organization had not taken into consideration earlier statements of Turkey regarding the need to uphold its obligations and responsibilities under the Charter and Council resolution 1996/31.

It focuses on the conclusions and recommendations of the expert group meeting which, among other things, called upon: the United Nations system, Member States and indigenous peoples’ organizations to recognize the rights and special needs of indigenous women and girls; Member States to adopt measures, in conjunction with indigenous peoples, to ensure that indigenous women and girls enjoy the full protection and guarantees against all forms of violence and discrimination; the United Nations system to support efforts and initiatives that provide support and protection to indigenous women and girls; and indigenous communities to consider seriously the problem of violence against indigenous women and girls in their communities through ways that include the recognition and dismantling of existing patriarchal social relations, the elimination of discriminatory policies and a continuous commitment to indigenous women’s rights in all indigenous institutions and at all levels.

He also pointed out that many applications are pending for longer periods, but no action is taken by any member of the Committee to expedite the decision on them, and called on Committee members to deal with all applicant organizations in a non-selective manner, arguing that the result of the vote would allow the Committee to continue its interaction and dialogue with the organization to alleviate the concerns expressed by different members.

Foreign citizens and stateless persons have the same rights, freedoms and responsibilities as do the citizens of the Republic of Moldova (right to residence, work and protection of work, education, rest, health protection, etc.); with the exceptions set by legislation in force (may not be nominated or involved in activities for which, according to the legislation in force, the Republic of Moldova citizenship is required, do not enjoy the right to elect and the right to be elected in legislative, executive and other eligible bodies, to participate in the universal suffrage, may not be members of parties and other sociopolitical organisations, may not exercise the military service in the armed forces of the Republic of Moldova).

The President also recalled that the States Parties have expressed satisfaction with the performance, efficiency, professional competence, responsiveness and dedication of the ISU and that there was general agreement among the Task Force members on the need to review the financing model of the ISU, in order to make it sustainable and predictable, and to achieve more equitable burden sharing.

Member countries need to review the obligations of the international conventions together with their existing legislation and practices, and to adjust, as appropriate, their legislation, documentation and procedures relating to international road transport.

With a preventive, participatory, policy-oriented approach the project succeeded in mobilizing family and community members in each project site, and, thereby secured their participation in the development of the local programme structure and delivery mechanisms, creating supportive environments for adolescent girls’ empowerment.

(c) Once the name of a Member State, the Holy See, in its capacity as observer State, or Palestine, in its capacity as observer, has been drawn by the representative of the Secretary-General, that Member State, the Holy See, in its capacity as observer State, or Palestine, in its capacity as observer, will be invited first to choose a meeting and then to draw from the appropriate box the number indicating the speaking slot in the meeting.

(a) Section 6(1) of the First Schedule of the LDC Ordinance provides that "A member of the Corporation who is in any way directly or indirectly interested in a contract made or proposed to be made by the Corporation, or in a contract made or proposed to be made by a servant or agent or a partner of the Corporation or, by a body corporate established by the Corporation which is brought up for consideration by the Corporation, shall disclose the nature of his interest at a meeting of the Corporation; and the disclosure shall be recorded in the minutes of the meeting of the Corporation, and the member shall not without the permission of the Chairman take part in any deliberation of the Corporation with respect to that contract and shall not in any event vote on any question concerning it".

At the 9th and 10th meetings of the Special Committee, the representatives of Bolivia (Plurinational State of), Brazil, China, Cuba, Ecuador, El Salvador, Guatemala, Indonesia, Mali, Mexico (as host country of the first Latin American and Caribbean Unity Summit), Nicaragua, Papua New Guinea, Paraguay, Peru, the Russian Federation, Sierra Leone, the Syrian Arab Republic, Tunisia, Uruguay (on behalf of the States members of the Southern Common Market (MERCOSUR) and associated States) and Venezuela (Bolivarian Republic of) also made statements on the question of the Falkland Islands (Malvinas).

The key factors that facilitated the smooth implementation by SIAP of all planned activities for 2009 were: (a) the strong support of the host Government, Japan, which continued to provide the bulk of cash contributions, administrative and infrastructure support, and fellowships for all four SIAP-Japan International Cooperation Agency (JICA) Tokyo Metropolitan Area (TMA)-based training courses; (b) the strong support of many other member States: cash and in kind contributions from those member States increased in 2009 compared with their level in 2008; and (c) close collaboration with United Nations agencies and international organizations, which provided the opportunity to combine efforts and address effectively the diverse capability-building needs of developing member States in the region.

(d) the dividend (or that part of the dividend in respect of which a right of election has been accorded) shall not be payable on shares in respect whereof the share election has been duly exercised (“the elected shares”) and in lieu and in satisfaction thereof shares shall be allotted credited as fully paid to the members who have duly exercised the said share election on the basis of allotment determined as aforesaid and for such purpose the Directors shall capitalise and apply out of any part of the profits of the Company available for distribution or any part of any of the Company’s reserve accounts (including any special account, share premium account and capital redemption reserve fund) as the Directors may determine, a sum equal to the aggregate nominal amount of the shares to be allotted on such basis and apply the same in paying up in full the appropriate number of shares for allotment and distribution to and amongst the allottees of the elected shares on such basis.
