In accordance with article 11 of the Rules and Regulations, claims are eligible for inclusion in the Register if: (a) the claimant is a natural or legal person; (b) the claimant has substantially met the technical requirements for submitting a claim; (c) the claim is within the jurisdiction of the Register of Damage; (d) the claimant has established a legal interest in the claimed damage; (e) the claimed damage is material; (f) the claimant has established a causal link between the claimed damage and the construction of the Wall in the Occupied Palestinian Territory; (g) the claimed damage was in fact sustained; (h) the documents and assertions in support of the claim are substantially consistent; and (i) the claim has been established prima facie, based on the information and documents submitted by the claimant, giving the claimant the benefit of the doubt in appropriate cases and bearing in mind the varying circumstances with regard to title and residency status of claimants.

However, in its general comment on article 18 of the Declaration, the Working Group noted that the prohibition of amnesty provided for by article 18 allowed “limited and exceptional measures that directly lead to the prevention and termination of disappearances, as provided for in article 3 of the Declaration, even if, prima facie, these measures could appear to have the effect of an amnesty law or similar measure that might result in impunity.

(c) ICAC should refer any corruption complaint against CE to the Secretary for Justice (SJ), regardless of whether the ICAC's investigation did not point towards a prima facie case.

National authorities, for instance, may recognize papers provided by de facto authorities as prima facie factual proof of personal status without this implying legal recognition of the entities providing the papers.

The Bills Committee has requested an explanation for raising the threshold from "prima facie grounds" to "reasonable grounds" for granting such leave.

For example, there is a prima facie need to break up and rearrange Part IV of the CO to improve its accessibility and clarity as the core company law provisions regarding company administration, company general meetings, accounts and audit, company inspections, directors and other officers, loans to directors, arrangements and reconstruction and shareholder remedies etc. are all crammed into this Part.

If the evidence available is inadequate to support a prima facie case against a professional accountant, the disciplinary proceedings do not come into play and there is no mechanism whereby the Society can compel the professional accountant to respond to enquiries arising therefrom.

In connection with prima facie cases of torture and ill-treatment, the alleged suspect should as a rule be subject to suspension or reassignment during the process of investigation, to avoid any risk that he or she might impede the investigation or continue any reported impermissible actions in breach of the Convention.

Such changes have gone beyond the sampling errors at the 95% confidence level, meaning that they are statistically significant prima facie.

Mr WONG Yuk-man said that having regard to the alleged recordings of DBC meetings circulating on the Internet from 20 October 2012, some Panel members considered that there was prima facie evidence to suggest that the decision of some of the major shareholders against making further investments into DBC was a result of political interference from the Liaison Office of the Central People's Government in the Hong Kong Special Administrative Region ("the Liaison Office").

In cases where a prima facie case of retaliation or threat of retaliation has been found by the organization’s ethics office and the internal oversight office declines to undertake the investigation, the executive head, or the head of the ethics office, should refer the matter to the Joint Inspection Unit for investigation.

In paragraph 66 of his previous report on the activities of the Ethics Office (A/64/316), the Secretary-General identified a serious lacuna in the Organization’s policy of protection against retaliation arising out of a case of prima facie retaliation referred to OIOS for investigation, which OIOS declined to investigate.

(3A) The publication in the Gazette by the Bar Council of a list of the names and addresses of those barristers who have obtained employed barrister's certificates for the period therein stated shall be prima facie evidence that each person named therein is the holder of such a certificate for the period specified in such list, and the absence from any such list of the name of any person shall be prima facie evidence that the person does not hold such a certificate.

By looking at the prima facie as presented by the Government, it cannot be established that there is no other alternative to deal with the situation should the amendments moved today be negatived. As for other explanations given, I think these are merely excuses made by the Government.

If it is perfectly all right for the vendor and the purchaser to come to an agreement on a property transaction without the help of an agent, there does not seem to be prima facie evidence that an estate agent must be qualified as, say, a professional surveyor to be competent.

This initial review of the application is intended to permit the independent body to assess the application swiftly and on a prima facie basis, so as to determine whether it should be entertained.

Due to the fact that there is a "trial supervision procedure" in the civil procedural law of the Mainland and a gap could arise between the date on which a judgment became final and the date of the establishment of a prima facie case for the trial supervision procedure, it may be considered whether such contingency needs to be covered.

The Committee recommends that, as part of its harmonization of federal antidiscrimination laws, the Racial Discrimination Act be amended, as far as civil proceedings are concerned, to require the complainant to prove prima facie discrimination, at which point the burden shifts to the respondent to prove no discrimination existed.

Patent offices do not as a rule make any attempt to question prima facie statements relating to entitlement or inventorship, although a third party may initiate a challenge both before and after a patent is granted.

In the event that on the basis of its preliminary review the Office determines that there is a prima facie case of retaliation, the matter is referred to the Internal Audit and Investigations Group, or to an alternate investigating mechanism if required, for formal investigation.

5.5 Contrary to the comments made by the State party on the lack of facts and evidence establishing the prima facie violation of articles 5 and 16, the author maintains that the Quebec authorities were well aware of the allegations and that, despite the many letters sent to the various ministers concerned, they did nothing to remedy the situation.

Several Committee members were of the view that, on reading the agenda of the General Conference, a number of other items had prima facie legal aspects that should be considered by the Committee, without prejudging the existence or otherwise of legal problems relating to those items.

And any such minutes of any meeting of the Directors or of any committee or of the Company, if purporting to be signed by the chairman of such meeting or by the chairman of the next succeeding meeting shall be receivable as prima facie evidence of the matters stated in such minutes.

The criteria include (a) whether the staff member engaged in an activity for which protection would be possible; (b) whether retaliation or a threat of retaliation took place; and (c) whether there is a prima facie case that the protected activity was a contributing factor in causing the action alleged to be retaliatory or a threat of retaliation.

For these reasons, the State party reiterates that the communication should be declared inadmissible under article 14 of the Convention and rule 91 of the Committee’s rules of procedure, as the petitioners failed to establish a prima facie case.

The Dispute Tribunal shall order a suspension of action on an application filed by an individual requesting the Dispute Tribunal to suspend, during the pendency of the management evaluation, the implementation of a contested administrative decision that is the subject of an ongoing management evaluation, where the decision appears prima facie to be unlawful, in cases of particular urgency and where its implementation would cause irreparable damage.
