As regards activities under the “ethics of science and technology, in particular bioethics”, the suggestion was made to place more emphasis on information and sensitization of the public-at-large and decision-makers, on the development of further normative instruments, on the promotion of ethics education, on the ethics of the use of science and technology, capacity-building and on multidisciplinary action.

Focus will be placed on promoting systemic reform of secondary education curriculum as well as national policies for enhancing linkages between general secondary and vocational programmes, the emphasis being on life skills development for employability and effective citizenship.

Emphasis should be placed on enhancing the capabilities of countries of the region to secure sustainable and safe drinking water supplies, urban water development and management strategies as well as issues related to urban and peri-urban drainage and sanitation, the rehabilitation of degraded water ecosystems, research on disappearing water resources, aspects of conflict prevention and resolution in relation to water issues, the creation of subregional water observatories, research in the sustainability of certain ecosystems and in particular of mangrove systems, as well as drawing on local knowledge for the protection of the environment.

Regarding women’s rights, it was reiterated that Afghanistan had ratified the Convention on the Elimination of All Forms of Discrimination against Women and had in place a law to protect women from violence, in conformity with the Convention, in order to give women an appropriate share in the Government and social life in Afghanistan.

For the purposes of more comprehensive protection, each State is encouraged to take all appropriate measures, in accordance with international law, to cooperate with other States concerned with a view to establishing jurisdiction over, and providing effective criminal sanctions against, those persons who have committed or have ordered to be committed acts referred to above (VII – Individual criminal responsibility) and who are found present on its territory, regardless of their nationality and the place where such act occurred.

The countries that are already contracting parties may take action to ensure that practical arrangements for full implementation are put in place.

The introductory report addressed a number of questions including: terminological issues; the general significance of subsequent agreements and practice in treaty interpretation; the question of inter-temporal law; the relationship between evolutionary interpretation and subsequent agreements and practice; the various elements of subsequent agreements and practice, including: the beginning and the end of the relevant period within which this phenomenon may take place, the identification of a common understanding or agreement by the parties, including the potential role of silence, questions of attribution of conduct to the State; as well as subsequent agreements and practice as a possible means of treaty modification.

The Committee also recalls that UNTSO military observers assigned to the Israel-Lebanon and Israel-Syrian Arab Republic sectors have been placed under the operational control of the Force Commanders of the United Nations Interim Force in Lebanon (UNIFIL) and the United Nations Disengagement Observer Force (UNDOF) to assist them in the fulfilment of their tasks, since the establishment of the two peacekeeping missions; this is without prejudice to the continued functioning of UNTSO in the two sectors should the mandates of the peacekeeping forces lapse (A/66/6 (Sect. 5), paras. 5.66 and 5.67).

The Advisory Committee received the following clarification: in spite of the timing of its presentation, the proposal of the Secretary-General to establish an Emergency Preparedness and Support Unit was intended not to respond specifically to requirements related to the recent natural disaster in Haiti, but rather to put in place arrangements to deal with any crisis that has occurred or that may occur as the result of natural disasters, malicious acts directed at the United Nations or other emergencies.

(29) To enter into any arrangements with any Governments or authorities (supreme, municipal, local or otherwise), or any corporations, companies, or persons that may seem conducive to the attainment of the Company's objects, or any of them, and to obtain from any such Government, authority, corporation, company or person any charters, contracts, decrees, rights, privileges and concessions and to carry out, exercise and comply with any such charters, contracts, decrees, rights, privileges and concessions; to apply for, promote and obtain any statute, order, regulation or other authorisation or enactment which may seem calculated directly or indirectly to benefit the Company, and to oppose any bills, proceedings or applications which may seem calculated or likely directly or indirectly to prejudice the Company's interests; and to procure the Company to be registered or recognised in or under the laws of any other foreign country or place.

Section II, title X, article 328 of the Family Code states: “When the health, safety, morality or education of a minor are jeopardized or insufficiently protected owing to the immoral behaviour or disability of the father and mother or of the person accorded the right of guardianship, or when, owing to misconduct or unruly behaviour, a minor gives these individuals cause for very serious dissatisfaction or renders them incapable of exercising guidance, the juvenile judge may on his own initiative, at the behest of the public prosecutor or at the behest of the father, mother or guardian, rule that the minor shall, for a period not to extend beyond the date of his coming of age, be visited regularly by a social worker or placed on probation.

The activities of nongovernmental organizations and other private actors, sometimes collectively referred to as “civil society” actors, are included within the scope of the draft articles only in a secondary manner, either as direct beneficiaries of duties placed on States (for example, of the duty of States to cooperate, in article 5) or indirectly, as being subject to the domestic laws, implementing the draft articles, of either the affected State, a third State or the State of nationality of the entity or private actor.

In establishing a budget for this work plan, the ISU has given due regard for the need to reduce costs and the desire of States Parties that the ISU place a relatively higher priority on certain aspects of its mandate.

As the Council’s meeting addresses the issue of nuclear-weapon-free zones, NAM reaffirms the need for the speedy establishment of a nuclear-weapon-free zone in the Middle East in accordance with Security Council resolution 487 (1981) and paragraph 14 of Council resolution 687 (1991) and the relevant General Assembly resolutions adopted by consensus; and, pending its establishment, NAM demands that Israel, the only country in the region that has not joined the Treaty on the Non-Proliferation of Nuclear Weapons or declared its intention to do so, renounce possession of nuclear weapons, accede to the Treaty without further delay, place promptly all its nuclear facilities under International Atomic Energy Agency fullscope safeguards according to Security Council resolution 487 (1981) and conduct its nuclear-related activities in conformity with the non-proliferation regime.

(h) Subject to the Ordinance, a Director may hold any other office or place of profit under the Company (other than the office of auditor) in conjunction with his office of Director for such period and on such terms (as to remuneration and otherwise) as the Directors may determine and no Director or intending Director shall be disqualified by his office from contracting with the Company either with regard to his tenure of any such other office or place of profit or as vendor, purchaser or otherwise, nor shall any such contract, or any contract or arrangement entered into by or on behalf of the Company in which any Director is in any way interested, be liable to be avoided, nor shall any Director so contracting or being so interested be liable to account to the Company for any profit realised by any such contract or arrangement by reason of such Director holding that office or of the fiduciary relation thereby established.

The main objectives of this Commission were the investigation of human rights violations which took place in this period, the discovery of the truth regarding these violations, the identification of the factors which led to them, the identification of the policies and practices which gave rise to them as an instrument for preventing future re-occurrence, the promotion of respect for human rights, the promotion of reconciliation and the support for the process of restoring the dignity of the victims.

(dd) To finance and take part in the floatation and registration of any company or corporation and the placing of its capital or securities or other issues and in particular but so as not to limit the generality of the foregoing to promote or join in the promotion of any subsidiary or other company having objects wholly or in part similar to those of this Company, or whose objects shall include the acquisition and the taking over of all or any of the assets and liabilities of or shall be in any manner calculated to advance directly or indirectly the objects or interests of the Company and to subscribe for, acquire and hold shares, stocks or securities of, and guarantee the payment of any securities issued by any such company.

(1) Any dispute howsoever arising directly or indirectly under or in respect of these by-laws or any of them in regard to any matter, act, event, or thing of whatsoever nature arising or occurring hereunder shall be governed by and interpreted in accordance with the laws of Hong Kong wherever the matter, act, event or thing shall take place and whatever the nationality, domicile or usual place of residence of any person or party to such dispute and every action or claim arising directly or indirectly therefrom brought by or against the Corporation shall be and the same is hereby submitted to the exclusive jurisdiction of a competent court of jurisdiction in Hong Kong.

Registration should contain the identity of the detainee, the date, time and place of the detention, the identity of the authority that detained the person, the ground for the detention, the date and time of admission to the detention facility and the state of health of the detainee upon admission and any changes thereto, the time and place of interrogations, with the names of all interrogators present, as well as the date and time of release or transfer to another detention facility.

(G) Whenever the Conversion Price is adjusted as herein provided, the Company shall give notice to the CP Shareholders that the Conversion Price has been adjusted (setting forth the event giving rise to the adjustment, the Conversion Price in effect prior to such adjustment, the adjusted Conversion Price and the effective date thereof) and shall at all times thereafter so long as any of the Conversion Rights remains exercisable make available for inspection at the principal place of business for the time being of the Company and the Registrar's Office prior to the Conversion Date a signed copy of the said certificate of the auditors or (as the case may be) of the relevant approved merchant bank and a certificate signed by a Director of the Company setting out the brief particulars of the event giving rise to the adjustment, the Conversion Price in effect prior to such adjustment, the adjusted Conversion Price end this effective date thereof.

(b) To ensure the quality of the rewrite exercise, the Administration should recruit staff of the right calibre to join the CBT, engage consultants with suitable experience and expertise to undertake related research, and put in place an appropriate administrative structure delineating the roles and duties of the various parties involved in the process.

In paragraph 2 (b) of Article 4, the Convention requires each party to take the appropriate measures to “ensure the availability of adequate disposal facilities for the environmentally sound management of hazardous or other wastes, that shall be located, to the extent possible, within it, whatever the place of their disposal”, while in paragraph 2 (c) it requires each party to, “ensure that persons involved in the management of hazardous wastes or other wastes within it take such steps as are necessary to prevent pollution due to hazardous wastes and other wastes arising from such management and, if such pollution occurs, to minimize the consequences thereof for human health and the environment”.

Waste management forms a part of private sector economic activities, with the state owning just the three hazardous waste collection centres and local governments owning several regional waste management centres – the main part of waste collection, sorting, recovery, etc. takes place in the private sector.

Given the regional dimension of the conflict, I reiterate the recommendation in my report on the situation of children and armed conflict in Chad (S/2008/532) that the respective United Nations country teams in the Sudan, Chad and the Central African Republic, as well as UNAMID, UNMIS, the United Nations Mission in the Central African Republic and Chad (MINURCAT) and the United Nations Peacebuilding Support Office in the Central African Republic (BONUCA) peacekeeping and political missions, dedicate the required resources to ensure that mechanisms are in place for information exchange and cooperation on cross-border child protection concerns such as the recruitment, release and reintegration of children.

(b) A Director may hold any other office or place of profit with the Company (except that of Auditors) in conjunction with his office of Director for such period and upon such terms as the Board may determine, and may be paid such extra remuneration therefor (whether by way of salary, commission, participation in profit or otherwise) as the Board may determine, and such extra remuneration shall be in addition to any remuneration provided for by or pursuant to any other Articles.

The Subcommittee is of the view that the Administration should first articulate on what the developments on WKR should help to achieve in the overall development of Hong Kong and how WKCD is strategically placed to catalyze the realization of a long-term arts and cultural vision for Hong Kong, and then formulate appropriate strategies and mechanisms to ensure efficacy of planning and to facilitate public involvement in the whole process.

That commentary might suggest, for example, that (f) the location from which financing was organized or authorized or the location of the debtor’s primary bank, would only be important where the bank controlled the debtor; that (k) the location of employees, might be important where employees could be future creditors, or less important on the basis that protection of employees is more an issue of protecting the rights of interested parties, is not relevant to the COMI analysis and is, in any event addressed by article 22 of the Model Law; that (e) the jurisdiction whose law would apply to most disputes, was not sufficiently important to be a determining factor and could, in any event, be a jurisdiction unrelated to the place from which the debtor was managed or conducted its business, factors that were both considered to be more important than (e).

(a) The steps taken to ensure that no one is involuntarily placed in psychiatric institutions for non-medical reasons; that any involuntary hospitalization for medical reasons is based on the advice of independent psychiatric experts; and that decisions by the State party to involuntarily hospitalize individuals in psychiatric institutions may be appealed.

With respect to the procedures meant to ensure its application, these take place through the ordinary mechanisms of application of international ratified documents: provision in national labour legislation of state and private control of correct application of the labour legislation in force (labour inspection, trade unions, associations of employers) and application of a system of sanctions for breach of internal norms adopted on the basis of international rules.
