A commission of inquiry has been set up by the Governor of the State to investigate the circumstances surrounding the fighting and the killings.

Only after a truly impartial accounting of the events of 31 May will all parties be satisfied that those responsible for violations of international law will be held to account.

Instead, further work will be undertaken under the overall guidance of the Co-Chairmen of the Study Group to put together a draft report providing the general background, analysing and contextualizing the case law, drawing attention to the issues that had arisen and trends in the practice and where appropriate make recommendations, including model clauses.

He therefore hopes that at the appropriate time, the Commission will elect to transmit the outcome of its work to the General Assembly as draft articles so that the Assembly can take an informed decision on their final form.

That will require an analysis of the risks to be faced in order to have the best possible knowledge of the parties to and circumstances of the conflict and to achieve a better comprehensive political and strategic direction.

The mandates of commissions/missions have variously included the establishment of facts and circumstances related to a single event,o or longer periods defined with varying degrees of precision.p The decision for a narrow or broad mandate no doubt depends on the circumstances leading to the establishment of each body, as well as the purpose intended to be achieved by the mandating authority.

To contextualize the Court’s decision and to decide the sovereign status of the Oneida Indian Nation, the Supreme Court relied upon the Doctrine of Discovery.

We hope that the Council will remain engaged in this matter, which has direct consequences for our work, and that we can be given regular briefings by the Executive Director of UNODC so that we can keep the Council thoroughly informed on the evolution of these cross-cutting threats.

The Government also has yet to release its long overdue white paper on the report and recommendations of a bipartisan panel established pursuant to the 2 April joint communiqué to investigate the causes and circumstances surrounding the political disturbances that occurred in March 2009.

Eventually, United States government attorneys filed a brief with the Supreme Court that was based in part on the Doctrine of Discovery and the era of the Vatican papal bulls; in it they argued that it was a well-recognized principle in international law that “the lands of heathens and infidels” were open to acquisition (taking) by “Christian nations”.51 A few comments will place the United States legal argument about “Christian nations” in context: until 1856, there existed a collective international political identity, comprising different monarchies and States, called variously by such names as “Christendom”, “the Christian common wealth” and “the Family of Nations” (“the Christian nations of Europe and their offshoots in America”).

Experience shows that there is no single format for how every commission of inquiry or fact-finding body is constituted and functions: the mandate, the situation of inquiry, the independent experts or members appointed, and the circumstances surrounding the body’s establishment and conduct, will vary each time.
