As some of the new prohibitions involve a consideration of whether a commercial practice causes or is likely to cause an average consumer to make a transactional decision that the consumer would not have made otherwise, the proposed section 13D provides that in determining the effect of a commercial practice on the average consumer, account must be taken of the material characteristics of such an average consumer, including that the consumer is reasonably well informed, reasonably observant and circumspect.

These savings stem from the provision of more cost-effective ground handling services in-house in Khartoum and El Obeid for the full period rather than contracting out to commercial vendors, the reduction of air flight hours, as improvements in maintenance and repairs to helipads have allowed for more efficient air fleet management that result in lower requirements for helicopters to position or reposition in Kadugli, the reduction in the holding of spare parts as major maintenance work for ageing medium and heavy vehicle fleets, as accident repair and painting is outsourced, the reduction in vehicle replacements, as vehicles are redeployed from Khartoum to the sectors and team sites in support of Comprehensive Peace Agreement-related activities, and dispatch service is outsourced in part in Khartoum to accommodate the increase in demand, as fewer vehicles are available.

(d) the dividend (or that part of the dividend in respect of which a right of election has been accorded) shall not be payable on shares in respect whereof the share election has been duly exercised (“the elected shares”) and in lieu and in satisfaction thereof shares shall be allotted credited as fully paid to the members who have duly exercised the said share election on the basis of allotment determined as aforesaid and for such purpose the Directors shall capitalise and apply out of any part of the profits of the Company available for distribution or any part of any of the Company’s reserve accounts (including any special account, share premium account and capital redemption reserve fund) as the Directors may determine, a sum equal to the aggregate nominal amount of the shares to be allotted on such basis and apply the same in paying up in full the appropriate number of shares for allotment and distribution to and amongst the allottees of the elected shares on such basis.

In its resolution 1970 (2011), the Council decided that the travel ban and asset freeze should apply to the individuals and entities designated by the Committee (a) involved in or complicit in ordering, controlling or otherwise directing, the commission of serious human rights abuses against persons in Libya, including by being involved in or complicit in planning, commanding, ordering or conducting attacks, in violation of international law, including aerial bombardments, on civilian populations and facilities, or (b) acting for or on behalf of or at the direction of individuals or entities identified in subparagraph (a).

(f) To apply for purchase or otherwise acquire any patents brevets d’invention licences concessions and the like conferring any exclusive or non-exclusive or limited right to use or any secret or other information as to any invention which may seem capable of being used for any of the purposes of the Company or the acquisition of which may seem calculated directly or indirectly to benefit the Company and to use exercise develop or grant licences in respect of or otherwise turn to account the property rights or information so acquired.

The Forum’s Action Plan includes guiding principles on ethical challenges posed by globalization, capacity-building in quality assurance and reviewing existing conventions on the recognition of studies to respond to the fast pace of developments brought about by the increase of transborder higher education.

The Council decision was later amended by Council decision 2011/178/CFSP by adding a ban on flights in the airspace of Libya, a ban on flights of Libyan aircraft in the airspace of the European Union and a requirement that nationals of European Union member States, persons subject to their jurisdiction and firms incorporated in their territories or subject to their jurisdiction should exercise vigilance when doing business with Libyan entities.

Those members who were opposed to the extension of cooling-off arrangements to all products and services took the view that cooling-off period would not be applicable to every industry, and that it might slow down economic activities and growth, or even lower the competitiveness and creativity of the market.

On Government’s support, the Hong Kong Accreditation Service (HKAS) could explore the introduction of accreditation service for more international recognized schemes while the Government Laboratory could conduct technical seminars to share testing methodologies and skills, and to organize proficiency tests / inter-laboratory comparison studies.

(h) To enter into any arrangement with any government or authority supreme municipal local or otherwise that may seem conducive to the Company’s objects or any of them and to obtain from any such government or authority any rights privileges and concessions which the Company may think it desirable to obtain and to carry out exercise and comply with any such arrangements rights privileges and concessions.

4.50 We may, at any time and without notice, apply any credit balance in any currency on any account of you and, where applicable, any account of the Authorized User, whether in the name of you or the Authorized User or in the names of you or the Authorized User and any other person, in or towards satisfaction of any indebtedness owed by you or the Authorized User to us under these Terms and Conditions in whatever capacity and whether actual or contingent or whether owed solely by you or the Authorized User or by you or the Authorized User and any other person.

A member did not support a territory-wide ban as the pattern of air pollution caused by vehicles were different in different areas, and it was more important to control the emission from moving vehicles than only focus on stationary vehicles.

(iii) sub-divide its shares or any of them into shares of smaller amount than is fixed by the Memorandum of Association of the Company, subject nevertheless to the provisions of the Law, and so that the resolution whereby any share is sub-divided may determine that, as between the holders of the shares resulting from such sub-division, one or more of the shares may have any such preferred or other special rights, over, or may have such deferred rights or be subject to any such restrictions as compared with the others as the Company has power to attach to unissued or new shares.
