That, as currently the Government does not have a set of effective administrative measures or legislation to protect trees, and as co-ordination is lacking because the responsibilities are scattered among various departments, which may result in trees in the territory being destroyed, damaged or removed due to urban development, negligence or other reasons, this Council urges the Government to expeditiously formulate an effective policy on protection of trees, and at the same time perfect existing relevant legislation, administrative measures as well as administrative framework, so as to effectively protect and preserve various kinds of trees, especially those that are exceptionally old and large, rare and valuable, of historical, cultural or memorial significance, and of special ecological or scientific research value.

However, there are concerns over the reprovisioning of the affected facilities (such as David Trench Rehabilitation Centre, Kennedy Town Swimming Pool, Centre Street Market West Block and open spaces); the possible adverse effect of ventilation shafts to the residents at Hill Road and to students and residents at Bonham Road; the proposed locations of station entrances and the preservation of tree walls at Forbes Street etc.

The term in excess of three years is beneficial to the Company because (i) any term shorter than the License Term and the Secondary Trademark License Term would increase the risks associated with, and lower the returns on, the Group’s investment in its brand building of the Philips Contributed Business; (ii) following Completion, the Group is expected to invest substantial management effort to broaden the Philips Contributed Business’ product range and market share, the benefits of which will extend beyond three years; and (iii) it is the intention of the Company to strengthen the Philips Contributed Business and the presence of the Philips Trademarks and the Secondary Trademark in the markets in which the Scope Products are sold.

However, work remains to be done in setting up mitigation strategies; carrying out a business impact analysis, together with the Office of Information and Communications Technology, to validate the prioritization of business processes at departmental level, train managers and critical staff to ensure they are able to continue critical business processes, and testing the business continuity plans and ensuring their maintenance (see also paragraphs 42 to 45 of document A/64/7/Add.9 in the present supplement).
