Given the regional dimension of the conflict, I reiterate the recommendation in my report on the situation of children in Chad (S/2008/532) that the respective United Nations country teams in the Central African Republic, Chad and the Sudan, as well as the BONUCA, MINURCAT and African Union-United Nations Hybrid Operation in Darfur political and peacekeeping missions dedicate the required resources to ensure that mechanisms are in place for information exchange and cooperation on cross-border child protection concerns such as the recruitment, release and reintegration of children.

This begs a fundamental review at UNESCO Headquarters in its recruitment and nomination policy, to ensure that staff deployed to cluster and national offices have the expertise to carry out technical support required and to earn the respect of the government and United Nations counterparts.

International action in the field of refugee protection should focus on the following four areas: eliminating the causes of conflicts in the world, including by improving States’ capacities for development; promoting respect for international refugee law, in complementarity with international humanitarian and human rights law, and ensuring that refugees’ human rights were not negatively affected by security or migration concerns; promoting international solidarity and partnerships and assisting States emerging from conflict to build their institutional capacities in order to take care of their citizens; and encouraging refugees’ voluntary repatriation to their home countries by financing national programmes, while strengthening international efforts, particularly the role of the Peacebuilding Commission.

Domestic workers without papers include women who should qualify for asylum or other protected status, but face deportation because States fail to respect their international obligations not to subject to refoulement persons who would face persecution or torture upontheir return.27 Victims of gender-based persecution — e.g. women at risk of “honour” killings — are also prone to becoming undocumented migrants vulnerable to exploitation, because national authorities fail to recognize such persecution or unrealistically assume that the victim has “internal flight alternatives” in her country of origin.

(k) The various programmes established by the State to assist Mexican migrant workers in other countries and the measures adopted to facilitate the reintegration of migrant workers returning to Mexico, such as the e-Migrantes portal, the Humane RepatriationProgramme and the Voluntary InteriorRepatriation Programme.

They invokeentirely new grounds against their expulsion to Afghanistan: first, that they sought asylum in Sweden, which is considered to be a serious crime in Afghanistan; second, that the first complainant is registered with the Afghan secret police because of having worked as an interpreter for asylum-seekers in Sweden; third, that some of their father’s old enemies are officials in the present Government and they will be killed because their name is known.

We continue to support UN efforts to advocate for the release of child soldiers and to educate former child soldiers, including UNICEF’s work to protect children in conflict zones.

It is alleged that both the PRRA officer and the IRB member who denied the refugee status application erred at law when they concluded that the author needed to prove that she and her daughter were personally targeted, disregarding the well-founded nature of their fear in view of the risks faced by members of a particular social group, i.e. women.

In the course of northbound trip, if a laden goods vehicle is repatriated by the Mainland Customs after going through the ROCARS and immigration departure clearance at Hong Kong land boundary control point, should the goods onboard be declared via the ROCARS and then bundled with the vehicle before it can enter Hong Kong again?

Noting with concern measures that can undermine human rights and the rule of law, such as the detention of persons suspected of acts of terrorism in the absence of a legal basis for detention and due process guarantees, the deprivation of liberty that amounts to placing a detained person outside the protection of the law, the trial of suspects without fundamental judicial guarantees, the illegal deprivation of liberty and transfer of individuals suspected of terrorist activities, and the return of suspects to countries without individual assessment of the risk of there being substantial grounds for believing that they would be in danger of subjection to torture, and limitations to effective scrutiny of counter-terrorism measures

Each of those activities — be they focused on the building of peace during a mission, on effectively transitioning to a sustainable and nationally owned peace as we withdraw, or on the deployment of the right civilian personnel to the right place and playing the right roles alongside our partners — are all aimed at delivering on our mandates, building national institutions, and ensuring that we do not have to return again once our missions have left.
