The Special Committee recognizes the necessity to intensify dialogue among Member States and the Secretariat, including in this forum, on ways and means to enhance the effectiveness of peacekeeping missions, including by addressing the requirement for peacekeeping missions to be able to deter, through the posture they adopt and actions they take, threats to the implementation of mandates, safety and security of peacekeeping personnel, and ongoing peace processes, in accordance with the Charter of the United Nations and the guiding principles outlined in section V.B of the present report.

In response to decision XVI/36 of the Sixteenth Meeting of the Parties requesting the Executive Committee to include a component in its annual report on the progress made and the issues encountered 19 in its consideration of the recommendations contained in the executive summary of the 2004 evaluation and review of the financial mechanism of the Montreal Protocol, the Executive Committee has annexed hereto its progress report to the Twenty-third Meeting of the Parties (Annex II).

The Chair of the meeting invited speakers to focus their contributions on the following specific issues regarding the criminalization of cultural property: (a) the availability of statistical data at the national level; (b) the existence of specific legislation on trafficking in cultural property and potential challenges in developing specific legislation; (c) the imposition of strong penalties for trafficking in cultural property; (d) the existence of penalties directed at specific stakeholders or sectors; (e) the question of reversing the burden of proof; (f) criminal law measures criminalizing those requesting and purchasing illicit cultural property; and (g) the use of new technologies in the fight against trafficking in cultural property and the criminalization of such use when done for illicit purposes.

In section IV, paragraph 12, of its resolution 63/248, the General Assembly requested the Secretary-General to enhance his efforts to address the problem cited in paragraph 10 of the same section, particularly as experienced with documentation considered at the second resumed session of the Fifth Committee during the sixtysecond session of the General Assembly, including convening the task force formed to study the matter, to provide an interim report on documentation concerning peacekeeping financing, to report on the results of those consultations and actions taken to solve the problem to the General Assembly, through the Committee on Conferences at its organizational session for 2009, in order for the Fifth Committee to consider the report at its second resumed session, and to provide a comprehensive report to the Assembly at its sixty-fourth session through the Committee on Conferences.
