1.68 The programme of work is expected to achieve its objectives and expected accomplishments on the assumption that States see a convergence between their national interests and the upholding of the international protection regime, and that there is continued political will on the part of all destinations for action to work towards ending the impunity of persistent violators ofchildren’s rights in situations of armed conflict.

Guatemala has seen the need to fight against impunity and UNICEF supports the public attorney’s office to change the way of this negative trend.

Cuba has repeatedly denounced and documented in detail, before the Security Council Committee established pursuant to resolution 1373 (2001), the impunity with which terrorist groups based in the United States have planned, incited, financed and carried out terrorist acts against Cuba, with the complicity and support of that country’s Government, in violation of its obligations under the abovementioned resolution, other Security Council and General Assembly resolutions and a number of international counter-terrorism instruments to which it is a party.

The trial schedule and budget proposals for 2010-2011 had not taken into account the resource requirements related to the trials of the fugitives who had still been at large when the budget had been finalized; the Secretary-General had indicated that those requirements would be addressed in the context of revised estimates as and when the fugitives were apprehended.

Urges Member States to continue to take the steps necessary to ensure the safety and security of humanitarian personnel, premises, facilities, equipment, vehicles and supplies located within their borders and in other territories under their effective control, recognizes the need for appropriate collaboration between humanitarian actors and the relevant authorities of the affected State in matters related to the safety and security of humanitarian personnel, requests the Secretary-General to expedite his efforts to enhance the safety and security of personnel involved in United Nations humanitarian operations, and urges Member States to ensure that perpetrators of crimes committed against humanitarian personnel on their territory or on other territories under their effective control do not operate with impunityand are brought to justice, as provided for by national laws and by obligations under international law

One guilty party who happens to be married may escape conviction when the only evidence against him is that of his spouse, whilst another would be convicted if he happens to be a bachelor, and so cannot preclude incriminating testimony under the spouse-protection rule.

In the preamble to the Statute, the States parties affirm that “the most serious crimes of concern to the international community as a whole must not go unpunished and that their effective prosecution must be ensured by taking measures at the national level and by enhancing international cooperation”, and that the parties are “determined to put an end to impunityfor the perpetrators of these crimes and thus to contribute to the prevention of such crimes”.
