The workshop was also intended to ensure that the representatives of States Parties mandated to analyse requests were fully aware of the analysing group’s working methods.

It was noted that while both matters belong to the larger family of mine action, mine clearance and victim assistance have different timelines, involve distinct national and international actors and relate to different national institutional and regulatory frameworks and budget lines.

In the meantime, our position in regard to what revenues are taxable has not changed, and we are awaiting the outcome of the case.

For the purposes of more comprehensive protection, each State is encouraged to take all appropriate measures, in accordance with international law, to cooperate with other States concerned with a view to establishing jurisdiction over, and providing effective criminal sanctions against, those persons who have committed or have ordered to be committed acts referred to above (VII – Individual criminal responsibility) and who are found present on its territory, regardless of their nationality and the place where such act occurred.

Concerning the proposal aimed at restructuring the draft articles, the Special Rapporteur was of the view that it would be better, at this stage, to continue working on the basis of the revised workplan contained in document A/CN.4/618; once all the draft articles had been elaborated, it would be appropriate to restructure, in a coherent and logical way, the whole set of draft articles.

At the 6th and 7th meetings of the Special Committee, the representatives of Bolivia (Plurinational State of), Brazil, China, Côte d’Ivoire, Cuba, Ecuador, El Salvador, Grenada, Guatemala, Guyana (speaking on behalf of UNASUR), Indonesia, Mali, Nicaragua, Paraguay (speaking on behalf of the States members and associated States of MERCOSUR), Peru, the Russian Federation, Sierra Leone, the Syrian Arab Republic, Uruguay and Venezuela (Bolivarian Republic of) also made statements on the question of the Falkland Islands (Malvinas) (see A/AC.109/2011/SR.6 and 7).

At the 10th meeting, on 16 October, the representative of the United States of America, on behalf of Afghanistan, Albania, Australia, Austria, Belgium, Bosnia and Herzegovina, Bulgaria, Canada, Chile, Colombia, Croatia, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Georgia, Germany, Greece, Haiti, Hungary, Ireland, Israel, Italy, Japan, Latvia, Lithuania, Luxembourg, Madagascar, Monaco, the Netherlands, Norway, Palau, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, the former Yugoslav Republic of Macedonia, Turkey, the United Kingdom of Great Britain and Northern Ireland and the United States of America, introduced a draft resolution entitled “Compliance with non-proliferation, arms limitation and disarmament agreements and commitments” (A/C.1/63/L.32).

Recognizing that all States Parties have a role to play, the Conference stresses that those States Parties seeking to build their capacity should identify their specific needs and requirements and seek partnerships with others, and that those States Parties, in a position to do so, should provide assistance and support.

The delegation also observed that a shop was kept by a civilian within the prison walls, but it was not clear how many prisoners could afford to buy food there.

In this context, the representative of Japan notified the Executive Committee of its understanding that, if the project were approved, the portion of the total funding approved for the project equivalent to the contribution of Japan should be spent only on activities that could be monitored in a transparent manner, and that the funds should be spent only for the protection of the ozone layer, without being diverted to other uses.

The countries that are already contracting parties may take action to ensure that practical arrangements for full implementation are put in place.

Therefore, the Conference urges all States Parties possessing advanced biotechnology to adopt positive measures to promote technology transfer and international cooperation on an equal and non-discriminatory basis, particularly with countries less advanced in this field, while promoting the basic objectives of the Convention, as well as ensuring that the promulgation of science and technology is fully consistent with the peaceful object and purpose of the Convention.

Notwithstanding the date on which the Agreement comes into effect, if from the date of this Agreement there is any repeal or amendment to the APCO (other than pursuant to the Government’s proposal to amend the APCO to cap the emissions of the Pollutants and to facilitate the use of emissions trading as described in a Legislative Council Panel on Environmental Affairs Paper reference CB(1) 418/07-08(07) dated 17 December 2007 (“Legislative Proposal”)) or any renewal of or change to any Specified Process Licence (other than to the amount of the Initial Cap or pursuant to the Legislative Proposal), which has a material effect on the Mechanism or HEC’s emissions performance or compliance with the Total Permissible Emissions, the Mechanism shall not apply to that Applicable Year and any subsequent Applicable Years until HEC and the Government have reached agreement as to the amendments to this Schedule that are required to give continued effect to the Mechanism.

That commentary might suggest, for example, that (f) the location from which financing was organized or authorized or the location of the debtor’s primary bank, would only be important where the bank controlled the debtor; that (k) the location of employees, might be important where employees could be future creditors, or less important on the basis that protection of employees is more an issue of protecting the rights of interested parties, is not relevant to the COMI analysis and is, in any event addressed by article 22 of the Model Law; that (e) the jurisdiction whose law would apply to most disputes, was not sufficiently important to be a determining factor and could, in any event, be a jurisdiction unrelated to the place from which the debtor was managed or conducted its business, factors that were both considered to be more important than (e).

The representative of Japan recalled that a decision by the Sixteenth Meeting of the Parties had requested the Executive Committee to consider “(a) Funding additional demonstration projects to help demonstrate the value of replacement of CFC-based chillers, pursuant to relevant decisions of the Executive Committee; (b) Funding actions to increase awareness of users in countries operating under paragraph 1 of Article 5, of the impending phase-out and options that may be available for dealing with their chillers and to assist Governments and decision makers; (c) Requesting those countries preparing or implementing refrigerant management plans to consider developing measures for the effective use of the ozone-depleting substances recovered from the chillers to meet servicing needs in the sector.

She furthermore suggested simpler, more elegant language for the paragraph, particularly with regard to the phrase “The Covenant embraces” in the second sentence and the word “corollary” in the penultimate sentence; as the latter sentence was currently drafted, it was unclear whether the public had a right to receive information from journalists or the Government, and the public was represented as less important than professional journalists.

The Committee recommends that the Report continue to feature such elements as economic and social analysis of the impacts of disasters, descriptions of regional cooperation and analysis of the role of space applications and information and communications technology (ICT) in disaster risk reduction, in addition to new elements, such as (a) information on champions for disaster risk reduction, (b) social and psychological analysis, (c) coverage of community practices vis-à-vis global perspectives, (d) analysis of a possible linkage between the Hyogo Framework for Action and the Millennium Development Goals and (e) linkage to the Global Assessment Report on Disaster Risk Reduction.

The delegation of Nepal requested that the secretariat help least developed and landlocked countries to conduct analyses on key export and import products; introduce single windows and paperless trade and the promotion of public-private sector dialogue on the implementation of trade and transit facilitation measures; provide a platform to discuss issues of common concern, paying particular attention to least developed and landlocked countries; promote value chains for agricultural and forestry products, including under initiatives such as “one village one product” programmes; and disseminate information and provide capacity-building assistance on the certification of organic foods and sanitary and phytosanitary standards, accession to APTA and overall assistance in the formulation of appropriate trade and investment policies.

Even in such a situation, in order for a State or international organization that has not objected in time to the reservation prior to the date of the succession of States to be able to object to it, it would be necessary that the maintenance of the reservation the territorial scope of which has been extended should upset the balance of the treaty: that is the sense of the restrictive formulation of this exception, which covers only those situations in which the territorial extension of the reservation “radically changes the conditions for the operation of the reservation”.

As they produce effects almost identical to those produced by reservations, these techniques nevertheless deserve to be mentioned in the part of the Guide to Practice devoted to the definition of reservations, if only so as to identify more clearly the key elements of the concept, distinguish them from reservations and, where applicable, draw appropriate conclusions with regard to the legal regime of reservations.

Taking into account the aforementioned geographical location of the diamond areas and the Group’s overall view that the basic economic structure of the former Forces nouvelles, in particular in those areas that continue to be under the influence of zone commanders, remains somewhat intact, it can be contemplated that this structure, or elements of this structure, continue to benefit from diamond revenues, as do non-Ivorian individuals and entities who remain unlicensed.

The State party explains the legislative history of those provisions and submits that the nature and scope of procedural obligations in the State party are adapted to the weight of the interests at stake in a case: the more important the case in terms of consequences for the parties, the more precise and exacting the requirements of keeping the official record of the trial and the court’s judgment.
