More importantly, the mediator must ensure that the parties do not jeopardize the results achieved during the negotiation process and strike a balance between the “winners” and the “losers”, helping them to see the agreement as an opportunity for both sides.

Both reports have received critical international acclaim and are recognized as essential tools for policy-makers.

I would also like to thank the Secretary-General for his comprehensive report (S/2009/72), the Japanese presidency of the Security Council for convening this open debate, and the Special Representative of the Secretary-General, Mr. Atul Khare, for the tireless work of the United Nations Integrated Mission in Timor-Leste (UNMIT) on the ground, which is highly appreciated by the international community.

These include: a deep-sea port being constructed on the Indian Ocean near the Rakhine State capital of Sittwe, and parallel road, high-speed rail, and oil and natural gas pipelines that will create an energy and trade corridor to China’s landlocked south west; the Kaladan multi-modal project that will create a transportation corridor between the Indian Ocean and India’s eastern seaboard and its landlocked north east; and the Dawei Development Project which, if completed according to plan, would include a large industrial estate and modern deep-sea port in the south, with road and rail links for transhipment of goods to Thailand and on to Vietnam, cutting several days off the sea route through the Straits of Malacca.

Several delegations commended the secretariat for documenting and sharing good practices and country experiences in eco-city development, promotion of public transportation, green buildings, 3R (reduce, reuse, recycle) strategies, sustainable urban planning, solid waste management, water supply, sewerage, participatory approaches to urban management, promotion of public-private partnerships and municipal finance.

The Committee was further informed that the Special Programme for the Economies of Central Asia was a collaborative programme of ESCAP and ECE, with project working groups focused on the areas of transport and border crossing; water and energy resources; information and communications technology for development; statistics; trade; and gender and economy.

Member countries need to review the obligations of the international conventions together with their existing legislation and practices, and to adjust, as appropriate, their legislation, documentation and procedures relating to international road transport.

This begs a fundamental review at UNESCO Headquarters in its recruitment and nomination policy, to ensure that staff deployed to cluster and national offices have the expertise to carry out technical support required and to earn the respect of the government and United Nations counterparts.

Nevertheless, other things being equal there is a presumption that the producer of a patented product, through the ability to exclude copies, will attempt to earn a monopoly profit and charge higher prices than would otherwise be the case.
