With a view to ensuring transparency, credibility and impartiality, Mr. Nasser al-Rayyes recused himself from the Commission because his membership conflicted with the provisions of the United Nations model protocol for national commissions of inquiry, notably the provision that commission members should not be closely associated with any individual, government entity, political party or other organization potentially implicated in the alleged violations, or an organization or group associated with the victim.

The Director of the Office for Outer Space Affairs of the Secretariat, Mazlan Othman, in her opening statement, called on United Nations entities to consider ways of accenting the role of space technology for the benefit of humanity, including in the context of the United Nations Conference on Sustainable Development (“Rio+20”), to be held in Rio de Janeiro, Brazil, in 2012, and the United Nations development agenda beyond 2015.

The wording proposed by the representative of Argentina matched that used in draft article 20, paragraph 4, which indicated that “The statement of claim should, as far as possible, be accompanied by all documents ...”.

Add. by adding three new subparagraphs and incorporating new words in one of the existing paragraphs related to the Associated Schools Project Network with a budgetary allocation of $100,000 from the regular programme budget, the Commission recommended that the General Conference invite the Director-General to take into account the establishment of a subportal for the Associated Schools Project Network in formulating the work plans and to seek additional funds from extrabudgetary sources for specific projects to be undertaken by the Network.

The Legal Committee did however consider that the drafting of certain articles could be improved so as to make them more precise and/or to comply with the usual rules of treaty law.

The expression “may, however, be included” reflects the optional nature of this divergent practice, whereas the final qualification “if no contracting State or contracting organization is opposed in a particular case” safeguards the application of the principle established in paragraph 1 should any one contracting State or contracting organization be opposed to that inclusion.

Similarly, the formulation “relations between States under a treaty”, found in article 1, is drawn from article 2, subparagraph (c), of the Vienna Convention, and places the focus on the relations existing under the treaty regime in question, thereby making it possible to distinguish the treaty relations between States, which are included within the scope of the draft articles, from the relations between States and international organization or between international organizations arising under the same treaty, which are excluded from the scope of the articles.

A host of concrete proposals were suggested to the coordinators of the Dialogue, such as: dialogue and networking among universities; dialogue among young scientists, involving UNESCO chairholders in dialogue activities; dialogue among student journalists and seasoned media practitioners from both regions; the holding of youth forums; reactivation of the Committee for the Translation of Literary Works and increase in the translation of Arabic works into European languages; a comparative study of school textbooks; dialogue involving professionals from cultural industries; the organization of an interregional conference on the image of Arab-Islamic culture in European history books.
