Most right to information laws include a comprehensive set of exceptions which protect all legitimate confidentiality interests (indeed, many may be criticised for being over-inclusive in this regard), so there should be no need for this to be extended by secrecy laws.

In his communications to Governments sent from April 2010 to May 2011, the Special Rapporteur expressed concern at a number of situations of alleged violations of the human rights of migrant workers, including (a) arbitrary arrest, sexual violence, torture and other forms of cruel, degrading and inhuman treatment or punishment; excessive use of force; and forced labour; (b) mass expulsions and forcible return; (c) inadequate standard of living, including lack of access to adequate food and housing; (d) sale of children, including for purposes of economic exploitation; (e) killings by border authorities; (f) trafficking for sexual and economic exploitation; (g) verbal and physical abuse by immigration authorities; (h) abuse and exploitation of domestic migrant workers, including denial of basic labour rights, such as non-payment of wages; (i) restrictions on freedom of movement of nationals; and (j) racist and xenophobic propaganda against migrants.

Some elements for a definition of the “notion of national security” in a few countries have been found here and there; and, refraining from examining systematically how each legal system has attempted to fix the limits of this notion, the author of that exercise writes: “For the time being, it suffices to note that: (a) it seems generally accepted that the term covers both external as well as internal threats; (b) Governments seem to be in no hurry to give a precise definition (or a non-restrictive definition) of this term in order, probably, to maintain their freedom of action; and (c) the risks arising from the imprecise nature of the notion have often been denounced by civil society and at times even by national courts”.99 94.
