There is no consensus on the definition of the term, and use of the term may mean legitimizing concepts that reinforce inequalities among economies, rationalize trade protectionism, involve new forms of conditionalities, promote further commodification and financialization of nature, and push new supposedly “green” technologies that do not conform to the Precautionary Principle established at the Earth Summit.

These were aimed particularly at the title (two suggested deleting the words “responsibility”, while one proposed the addition of the word “obligation”) and the use of certain words or expressions (such as “encourage” [...] [...]

Nevertheless, Portugal suggests the simple deletion of that expression; the term “should” is enough for the purpose.

That approach would make it possible to compare writers who, over and beyond their differing historical, geographical, social and cultural contexts, shared the common feature of being authors of the South or identifying with and speaking from the “South”.

(f) The modified United Nations emblem in the general principle set forth in paragraph 16 (f) refers to emblems developed for special events and does not refer to the United Nations emblem modified by placing the words “United Nations” on the top and “We support” or “We believe” on the bottom, which is generally reserved for nongovernmental organizations.

Indeed, the word “all” should replace the word “such” immediately before the word “expression” to emphasize that all forms of expression, and not just offensive ones, were subject to the limitations set out in articles 19 and 20.

The international community should come to a consensus on the meaning of the term “empowerment”, using the skills and confidence framework proposed by Soroptimist International.

I have generally concurred with the Committee’s decision on the case of Benaziza v. Article 3 (2) reflects the realities that not all definitional issues could be dealt with adequately over the long span of a treaty’s life without some reference to the potentially more fluid and responsive laws of the parties to that treaty, and that treaties defining all terms would be potentially more complicated and harder to negotiate.
