Therefore, in really exceptionally sensitive cases where the parties agree that there is high risk of revelation of identities of persons even with the disclosure of the most basic information about the mediation, then in line with the spirit of clause 8(2)(e), it is open to the parties to specifically agree that certain details of the mediation communication, which normally can be disclosed for the purpose of research, evaluation or educational purposes, should not be disclosed in the specific case at hand so as to prevent revelation of the identities of the persons concerned.

Of these, the most important are the right to life, the right to be free from arbitrary detention, the right to a fair trial and the freedoms of expression and association.

In this regard, special emphasis shall be placed on fostering intercultural dialogue and multilingualism as well as sustaining diversified cultural industries, in particular through the Global Alliance for Cultural Diversity Project and through capacity-building in the field of crafts and design for sustainable development.

Full respect for human rights, fundamental freedoms and the rule of law is also, in our view, an indispensable tool for effective counter-radicalization and for combating terrorism narratives and appeals.

After the adoption of the draft resolution, a statement in explanation of position was made by the representative of Sweden (on behalf of the States Members of the United Nations that are members of the European Union, the candidate countries Croatia, the former Yugoslav Republic of Macedonia and Turkey; the stabilization and association process countries Albania, Bosnia and Herzegovina, Montenegro and Serbia; and Armenia, Georgia, Iceland, Liechtenstein, Norway, the Republic of Moldova and Ukraine) (see A/C.4/64/SR.9).

By drawing upon OECD work where it is relevant to developing countries, the United Nations Model Tax Convention gives greater profile and significance to that work, but by explaining possible alternatives, it helps countries to decide which approach better suits their circumstances and priorities in negotiating bilateral treaties.

Under civil law, personal rights comprise the rights to life, to personal freedom, to physical and psychological integrity, to honour, to the intimacy of one’s private life, to the inviolability of one’s correspondence and home, to the protection of personal data, to one’s image and wording, to one’s personal truth, to one’s name and personal identification.
