Application of the death penalty was restricted to perpetrators of the most heinous crimes, and there was a moratorium on capital punishment by stoning.

Its regime of restraining orders is intended to deter perpetrators of family violence from inflicting further violence, while allowing families to remain together in peace.

Until 2006, violent sexual acts were considered “private crimes” where a perpetrator could go free if the woman consented.

Those allegations must be fully investigated and, if confirmed, their perpetrators brought to justice.

Migrants, refugees, asylum-seekers and members of minorities appear to be among the vulnerable groups targeted by these acts, which constitute a blatant violation of the rights to life and to security of person, guaranteed by articles 6 and 9, respectively, of the International Covenant on Civil and Political Rights.

(a) Sexual violence against women and girls, including rape, gang rape, forced prostitution, threats of rape, sexual harassment, including in the workplace, committed by private individuals, including armed individuals, and military, security and law enforcement personnel, including in detentionrelated situations and in situations of internal displacement, as well as failure by States, resulting in a climate of impunity, to exercise due diligence to prevent such violations, and to adequately and in a timely manner investigate, prosecute and punish the perpetrators, failure by States to provide adequate protection, support and reparation for victims and their families, including medical and psychological care, and failure by States to ensure access to justice

In order to understand the dynamics of killings by non-State actors, which are often underreported and under-studied, reports to the Council and the General Assembly have included global studies of particular phenomena such as killings by vigilantes and mob justice (A/64/187, paras. 15-83) and killings of “witches” (A/HRC/11/2, paras. 43-59).

Unfortunately, the TRCT has no mandate to prosecute and when combined with the lack of cooperation, a compromised fact-finding process is unlikely to support larger reconciliation efforts.

Reports also point towards other perpetrators such as Government-backed militias and Chadian opposition groups.

(b) Other forms of violence against women and girls, including domestic violence, and harmful traditional practices, including forced and early marriage, as well as failure by States, resulting in a climate of impunity, to exercise due diligence to prevent such violations and to adequately and in a timely manner investigate, prosecute and punish the perpetrators, failure by States to provide adequate protection, support and reparation for victims and their families, including medical and psychological care, and failure by States to ensure access to justice

Under human rights law, the State is not only prohibited from directly violating the right to life, but is also required to ensure the right to life, and must meet its due diligence obligations to take appropriate measures to deter, prevent, investigate, prosecute and punish perpetrators.

In 11 incidents, the perpetrators were identified as Government forces (Border Intelligence Force, Central Reserve Police, SAF and Police Forces).

A critical comparison, when addressing the killings of women, can be seen in the labelling in the West of femicides as ―crimes of passion‖ stemming from individual violent behaviour; and in the East, as ―crimes of honour‖ arising from cultural/religious practices and beliefs.

Bringing perpetrators of crimes to justice, publicly condemning such incidents and reaching out to the victims, as occurred in a few instances during the reporting period, would serve to alleviate some concerns among the communities and foster a feeling of increased security.

(c) Trafficking in women and children, including internal human trafficking, for the purposes of forced labour, in particular for domestic servitude, and commercial sexual exploitation, as well as failure by States, resulting in a climate of impunity, to exercise due diligence to prevent such violations and to adequately and in a timely manner investigate, prosecute and punish all perpetrators, as well as those fuelling the demand for sexual exploitation, such as identified sex tour operators

Information on steps to address the plight of the victims of human rights violations committed by private military and security company personnel and on short-term measures to assure the accountability of perpetrators would be appreciated.

(e) Increase efforts to broaden the respect for and protection of human rights and enforce the rule of law, including through measures to improve the performance and independence of the judiciary; to establish the National Independent Human Rights Commission consistent with international norms and the Paris Principles; to take decisive action against the perpetrators of violent acts, including against women, children and “albinos”; and to improve efforts to end impunity and conclude existing cases expeditiously, including those relating to the Gatumba massacres and the Kinama killings

The investigation identified one A. Airiyan as the perpetrator of this crime.

The complainant could not identify any of her alleged aggressors, except the policeman who is alleged to have pulled her with force prior to her arrest and this would not in any case constitute ill-treatment.

(d) Abuse of power by military, security and law enforcement personnel, humiliation, lack of due process and delays in proceedings, arbitrary arrest and detention, failure to grant a fair trial and impunity resulting from failure by States to promptly investigate, prosecute and punish the perpetrators

They cast as enemies of peace those of us who insist that we must first erect a sturdy barrier to keep the crocodile out, or at the very least jam an iron bar between its gaping jaws.

(i) demanded the rapid identification of all the perpetrators and sponsors of this assault, for them to be brought to justice, without prejudice to actions that could be initiated by the relevant international mechanisms

CAT recommended that Algeria specify that waivers of prosecution do not apply under any circumstances to crimes such as torture, including rape, and enforced disappearance; that such past or recent cases are investigated systematically and impartially; that the perpetrators are prosecuted and punished and the victims are compensated.
