In this context, the representative of Japan notified the Executive Committee of its understanding that, if the project were approved, the portion of the total funding approved for the project equivalent to the contribution of Japan should be spent only on activities that could be monitored in a transparent manner, and that the funds should be spent only for the protection of the ozone layer, without being diverted to other uses.

In this context, it was suggested that both States Parties and the broader implementation community need to make sure that this actually happens, including moving beyond the general discussions of how to ensure that girls, boys, women and men have equal access to the resources generated through implementation of the Convention, and, by asking why progress has been so slow.

The Commission highlighted the importance of capacity-building in the use of ICTs for national development, including in the areas of promoting small and medium enterprises, delivering public services, enabling access to basic services — such as education, finance and health — and improving sustainable livelihoods as well as facilitating social transformation.

The Commission also noted the key step in eradicating poverty would be to improve access to basic services, such as energy, water and sanitation.

The organization and functioning of the courts and tribunals remain in line with the fundamental principles established in particular by international instruments on justice, these being: the independence and impartiality of the judiciary; equality before the law without discrimination; presumption of innocence; the rule requiring that offences and punishments shall be strictly defined by law; the right to a second hearing and the right to a defence, to assistance and to legal aid.

APCICT seeks support from the Commission in (a) advocating for ICTD and APCICT programmes in individual member countries; (b) allocating budgets for ICTD capacity-building and promoting ICT training for national and local governments; (c) identifying potential partners for the roll-out of the APCICT core programme, the Academy of ICT Essentials for Government Leaders and the collection and documentation of case studies of good practices; and (d) encouraging regional cooperation in the sharing of resources, experts and trainers, with particular focus on the participation of women.

Some delegations highlighted the importance of convening Codex sessions in developing countries as this allowed the co-hosting country to gain more experience with Codex work, and could also facilitate attendance of the countries in the region concerned, and therefore this mechanism should be used on a regular basis.
