The inordinate length of translation times, especially in cases of selfrepresented appellants, calls for greater explanation than suitable for a report of this size, but it can be said that efforts are under way to more effectively liaise with the supervisors in the Conference and Language Services Section on a continual basis in order to assess progress and determine the need for requesting prioritization of specific translations, and to readdress the internal requirement of the Conference and Language Services Section that the revision process for translation of a judgement must be accomplished as a whole, rather than volume by volume (which would allow for gradual release of translated portions).

While searching for a solution to the problem in the short term, the Council needed to also find a long-term solution to the question of resources for the universal periodic review process to avoid ad hoc measures, which risked undermining the principle of equal treatment for all States.

In the agreement between Croatia and the Executive Committee, the maximum allowable consumption for Annex A, Group I (CFCs) for the year 2005 was 65 ODP tonnes, for 2010 0 ODP tonne; and for the years in between, the agreement provides no exact figure but stipulates that "The By-Law on Substances that Deplete the Ozone Layer (of 30 January 1999) includes a clause on importing on an exceptional basis between 2006 and 2009 up to 21.9 ODP tonnes of Annex A (Groups I and II) and/or Annex B (Groups II and III) or products containing these substances, when these substances and/or products are for preserving human, plant and/or animal life; national defence, safety and fire-fighting; and scientific research safety, when suchproducts cannot be replaced by environmentally-sound and economically-viable alternatives”.

It was suggested that the States Parties reflect on how they can enable the necessary in-depth analysis and discussion of the requests in order to ensure that high quality requests continue to be the norm.

These include: a deep-sea port being constructed on the Indian Ocean near the Rakhine State capital of Sittwe, and parallel road, high-speed rail, and oil and natural gas pipelines that will create an energy and trade corridor to China’s landlocked south west; the Kaladan multi-modal project that will create a transportation corridor between the Indian Ocean and India’s eastern seaboard and its landlocked north east; and the Dawei Development Project which, if completed according to plan, would include a large industrial estate and modern deep-sea port in the south, with road and rail links for transhipment of goods to Thailand and on to Vietnam, cutting several days off the sea route through the Straits of Malacca.

It is therefore important for the industry to continue closely monitor the manufacturing process, identify potentially problematic conditions and develop methods that would prevent or reduce the formation of EC and maintain EC contamination at the lowest level possible during processing and storage.

The five factors with the most potential to cause slippage in projected estimates for completion of judgements on appeal are the delays associated with or caused by: (a) the nature of multi-appellant cases; (b) the inordinate amount of pre-appeal motions; (c) the inordinate length of time for translation of trial judgements into Bosnian/Croatian/ Serbian, as well as for translation of written submissions into one of the Tribunal’s working languages and Bosnian/Croatian/Serbian, especially in cases of selfrepresented appellants; (d) amendments to grounds of appeal, especially following translation of the trial judgement (mainly for represented appellants); and (e) understaffing and/or lack of experience in appeals support.

His delegation requested the international community, as a matter of urgency: to take all the measures indicated in the conclusions and recommendations of the report contained in document A/64/339, including the imposition of sanctions on Israel if it failedto comply fully with all United Nations resolutions; to request Israel to allow the members of the Special Committee to enter the occupied territories in order to fulfil its mandate; and to require the Israeli Government to pay appropriate compensation for the damage it had inflicted on the Palestinians and the population of the occupied Syrian Golan.

The Commission was informed of initiatives that were being undertaken by Pacific island developing countries to protect biodiversity and the maintenance of ecosystem services, such as the Phoenix Islands Protected Area in Kiribati, the largest marine protected area in the Pacific Ocean, and the Coral Triangle Initiative, which covered a number of countries in the Asia-Pacific region, included the greatest extent of mangrove forests in the world and provided a critical spawning and juvenile growth area for tuna and other globally significant fish species.
