He reaffirmed his Government’s support for the work of the United Nations in Nigeria and its determination to ensure that the perpetrators of terrorist acts did not escape with impunity.

While acknowledging that equal weight should be given to all grave violations against children, and taking into account the ever-increasing need to protect schools and hospitals, as noted in the present and previous reports, it is recommended that the Security Council consider expanding the gateway to the annexes of my report to include parties that attack schools and/or hospitals.

The Strugar Trial Chamber held that the elements of this crime are satisfied if: (1) the damage or destruction has been committed to institutions which may clearly be identified or regarded as dedicated to religion; (2) the property was not used for military purposes at the time of the acts and must not have been in the immediate vicinity of military objectives; and (3) the perpetrator acted with the intent to destroy the property.

It is also advisable to identify appropriate criteria for reparations, to establish the obligation to provide reparations from the beginning of voluntary depositions, to reinforce State mechanisms for accessing assets of perpetrators, to integrate differential approaches and to ensure adequate coordination with other transitional mechanisms.

As expressed in my report last year (A/64/742-S/2010/181), in most cases, victims and witnesses provide little information on the identity of the alleged perpetrators and the uniforms alone do not always substantiate the alleged perpetrator’s affiliation.

(c) The implication of traditional dispute mechanisms in the perpetuation of harmful practices, and the impunity that perpetrators of those practices often enjoy as a result of inaction and complicity of local and State authorities, religious leaders and elders.

Tanaka at first wished to punish the troublemaker severely, but he faced great pressure from the army and he could not explain the matter clearly to the emperor; at last he was forced to resign.

The State party should take all necessary steps to ensure that all persons, including those monitoring human rights, are protected from any intimidation or violence as a result of their activities and exercise of human rights guarantees, to ensure the prompt, impartial and effective investigation into such acts, and to prosecute and punishperpetrators and provide compensation to victims.

In terms of the capacities of States of the region, we believe that the United Nations system is in a position to play a key role in helping States, in particular with the assistance of the United Nations Office on Drugs and Crime, to develop their capacities and their national strategy to combat piracy and transnational organized crime, including the drawing up of a national legal framework that makes it possible to charge and try alleged perpetrators of acts of piracy and to promote cross-border judicial and security cooperation.

Rule 4B also applies off school grounds when the misconduct by the alleged perpetrator is because of the school employee’s performance of his/her official duties.

(o) To intensify efforts to prevent all forms of violence against women and girls, provide protection to the survivors, investigate, prosecute and punish the perpetrators of violence against women and girls, and engage men and boys, as well as community and faith-based organizations, in eliminating violence against women

To that end, the unit was tasked with verifying, upon judicial order, the commission of such offences, gathering evidence and creating a database on such acts and theirperpetrators.

It should also ensure that such cases are thoroughly investigated and that the perpetrators are prosecuted, and if convicted, punished with appropriate sanctions, and that the victims are adequately compensated.

(b) Develop a national plan to prevent and eradicate violence against women and girls, including public sensitization and education that domestic violence is unacceptable, capacity building for law enforcement and judiciary, protection and rehabilitation of victims as well as punishment of perpetrators.

It also encourages the State party to ensure that law enforcement officials approached with complaints of racial discrimination have adequate expertise and authority to deal with offenders and to protect victims of discrimination.

In response to those attacks, on 6 and 7 July 2010 the Joint Special Representative met with Government officials in Khartoum, including Vice-President Ali Osman Taha, the new Minister for Foreign Affairs, Ali Karti, and the new State Minister for Humanitarian Affairs, Mutrif Siddiq, to reiterate earlier demands that the Government conduct thorough and timely investigations into the attacks and criminal acts committed against UNAMID peacekeepers and prosecute and punishthe perpetrators of the attacks.

Indonesia is of the view that, in addition to the Board of Inquiry, which has an understandably limited mandate, an independent commission should be established with the mandate to look into possible crimes against humanity committed during the Israeli military assault and to bring the perpetrators to justice.

The Forum recommends that all States install gender-sensitive action plans and independent self-reporting mechanisms that give particular attention to indigenous peoples, with the aim of protecting victims, prosecuting perpetrators and preventing human trafficking and related serious exploitation in all its forms, in accordance with the United Nations Convention against Transnational Organized Crime, the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, the Protocol against the Smuggling of Migrants by Land, Sea and Air, both supplementing the UnitedNations Convention against Transnational Organized Crime, and the Convention on the Rights of the Child.
