During 2009 and 2010, Argentina and the United Kingdom reiterated their respective positions regarding the sovereignty dispute, including by Argentina through the issuance of press releases on 10 June 2009 in connection with the observance of the “Day of Affirmation of Argentine rights over the Malvinas Islands” and other areas, and on 3 January 2010 “on the occasion of the latest anniversary of the illegal occupation of the Malvinas Islands by the United Kingdom”, and by the United Kingdom through written demarches at the United Nations rejecting territorial and other claims made by Argentina.

On 3, 6 and 10 October 2011, during the debate on decolonization issues in the Special Political and Decolonization Committee (Fourth Committee) of the sixtysixth session of the General Assembly, the delegations of Argentina, Bolivia (Plurinational State of), Brazil, Chile, Costa Rica, Cuba, Ecuador, Guatemala, Guyana, Mexico, Nicaragua, Paraguay, Peru, Uruguay and Venezuela (Bolivarian Republic of) referred to the question of the Falkland Islands (Malvinas), as reflected in A/C.4/66/SR.2, A/C.4/66/SR.5 and A/C.4/66/SR.6.

They further state that, in respect of the Treaty of Lisbon modifying the Treaty of the European Union and the Constitutive Treaty of the European Community, the inclusion of the Malvinas, South Georgia and the South Sandwich Islands in the regime of the Association of the Overseas Countries and Territories is incompatible with the legitimate rights of the Argentine Republic and with the existence of a sovereignty dispute over the said archipelagos.

The illegitimate occupation by the United Kingdom of Great Britain and Northern Ireland led to the adoption by the General Assembly of resolutions 2065 (XX), 3160 (XXVIII), 31/49, 37/9, 38/12, 39/6, 40/21, 41/40, 42/19 and 43/25, in which it recognizes the existence of a sovereignty dispute regarding the “Question of the Falkland Islands (Malvinas)” and urges the Governments of Argentina and the United Kingdom of Great Britain and Northern Island to resume negotiations in order to find as soon as possible a peaceful and lasting solution to the dispute.

At the 9th and 10th meetings of the Special Committee, the representatives of Bolivia (Plurinational State of), Brazil, China, Cuba, Ecuador, El Salvador, Guatemala, Indonesia, Mali, Mexico (as host country of the first Latin American and Caribbean Unity Summit), Nicaragua, Papua New Guinea, Paraguay, Peru, the Russian Federation, Sierra Leone, the Syrian Arab Republic, Tunisia, Uruguay (on behalf of the States members of the Southern Common Market (MERCOSUR) and associated States) and Venezuela (Bolivarian Republic of) also made statements on the question of the Falkland Islands (Malvinas).

No agreement between Argentina and the United Kingdom has been reached on the Argentine proposal made in 2003 aimed at the establishment of direct, regular air service between mainland Argentina and the Falkland Islands (Malvinas) operated by an Argentine air company.

For its part, according to information provided by Argentina, the Argentine Republic has rejected the territorial application effected by the United Kingdom of the United Nations Framework Convention on Climate Change and the Kyoto Protocol, the Agreement on the Conservation of Albatrosses and Petrels, the Convention on International Trade in Endangered Species of Wild Fauna and Flora, the Convention on the Conservation of Migratory Species of Wild Animals and the Ramsar Convention on Wetlands, on the grounds that the Falkland Islands (Malvinas), along with the surrounding maritime areas, were an integral part of the territory of Argentina.

At the 9th and 10th meetings of the Special Committee the representatives of Bolivia, Brazil, China, Cuba, Ecuador, El Salvador, Grenada, Guatemala, Honduras, Indonesia, Mali, Paraguay, Peru, the Russian Federation, Sierra Leone, the Syrian Arab Republic, Saint Lucia, Tunisia, Uruguay and the Bolivarian Republic of Venezuela also made statements on the question of the Falkland Islands (Malvinas).

[...] [...] question of the Malvinas Islands adopted by the United Nations General Assembly and by many other international entities and to negotiate with the Argentine Republic in order to find a just and lasting solution to the sovereignty dispute over the Malvinas Islands, [...] [...]

On 3 October, the representative of Uruguay, speaking on behalf of MERCOSUR, the State party in the process of accession, Venezuela (Bolivarian Republic of), and the associated States of Bolivia (Plurinational State of), Chile, Colombia, Ecuador and Peru, inter alia, reiterated their support for the legitimate rights of the Argentine Republic in the sovereignty dispute over “the Malvinas Islands, South Georgia Islands and South Sandwich Islands and the surrounding maritime areas”, which had been reaffirmed in the Joint Communiqué of the Presidents of the States parties of MERCOSUR and associated States had adopted on 29 June 2011 at the 41st meeting of the Council of the Common Market.

For its part, according to information provided, Argentina has consistently rejected the territorial application by the United Kingdom of these various instruments, as well as the designation of the Territory as an Overseas Territory of the United Kingdom or any other similar designation.

In that connection, by a letter of 4 January 2011 (A/65/683), Argentina rejected in its entirety the communication from the United Kingdom (A/65/617), stating, inter alia, that the United Kingdom was “violating United Nations doctrine on the Malvinas issue by requesting the circulation of a letter from the so-called authorities of a colonial territory with a transplanted population that is the object of a sovereignty dispute, the solution of which involves only the two parties to the dispute: Argentina and the United Kingdom”.

Further, on the same occasion, the Presidents of the countries in question had adopted a special declaration in which they rejected the statements of the British Minister of Defence regarding the deployment of combat aircraft and naval power in the “Malvinas Islands zone”, as well as the conduct of military exercises by the United Kingdom, including the firing of missiles from the Territory (see A/C.4/66/SR.2).

First, the Argentine Republic finds it necessary to remind the United Kingdom that there is a sovereignty dispute between the Argentine Republic and the United Kingdom over the Malvinas, South Georgia and South Sandwich Islands and the surrounding maritime areas and that the existence and characteristics of the dispute have been recognized by the United Nations in General Assembly resolutions 2065 (XX), 3160 (XXVIII), 31/49, 37/9, 38/12, 39/6, 40/21, 41/40, 42/19 and 43/25, as well as the resolutions adopted each year by the Special Committee on decolonization, whereby both Governments are urged to resume negotiations in order to find as soon as possible a peaceful solution to the dispute.

19. We reaffirm the need for the Government of the Argentine Republic and the United Kingdom of Great Britain and Northern Ireland to resume negotiations in accordance with the principles and the objectives of the United Nations Charter and the relevant resolutions of the General Assembly, in order to find, as soon as possible, a peaceful solution to the sovereignty dispute relating to “the Question of the Malvinas Islands”, which seriously damages the economic capacities of the Argentine Republic and the need for both parties to refrain from taking decisions that would imply introducing unilateral modifications in the situation while the Islands are going through the process recommended by the General Assembly.

Similarly, within the United Nations, the mandate of the mission of good offices of the Secretary-General has been continued and the question of the Malvinas Islands has, since 2004, been on the permanent agenda of the General Assembly, as an item that can be discussed subject to prior notification by a Member State.

[...] 28 October 2008 The Malvinas and South Atlantic Department of the Ministry of Foreign Affairs, International Trade and Worship presents its compliments to the Embassy of the United Kingdom of Great Britain and Northern Ireland and has the honour to refer to Note OTD No. 10/11/08 delivered by that Embassy on 14 November 2008 in response to Note DGMAS No. 317 of 28 October 2008, in which the Argentine Government lodged a formal protest against the siting of missile firing facilities in the Malvinas Islands.

As previously reported, regarding the constitutional reform process in 2008, Argentina protested against what it termed “a unilateral act” carried out by the United Kingdom in “disregard for the resolutions on the question of the Malvinas Islands duly adopted by the General Assembly and the Special Committee on Decolonization” and in “violation of the spirit of the provisional understandings under the sovereignty formula” reached by Argentina and the United Kingdom (see A/63/542, annex I).

Likewise, the Argentine Government kindly requests ICANN and subordinate bodies to consider “NIC-ARGENTINA” as the only valid delegated authority for the “.ar” domain in charge of authorizing the registration of all the domain names within the Argentine Republic, including those addressed in the Malvinas, South Georgia and South Sandwich Islands.

That action included written démarches and the issuance of press releases by Argentina on 10 June 2011 in connection with the observance of the “Day of Affirmation of Argentine rights over the Malvinas Islands” and other areas and on 3 January 2012 “on the occasion of the latest anniversary of the illegitimate occupation of the Malvinas Islands by the United Kingdom” and remarks to the media, as well as written démarches by the United Kingdom before the United Nations, rejecting territorial and other claims made by Argentina (see A/AC.109/2011/14; A/66/653, annex; and A/66/677, annex).

As reflected in the official records of the sixty-sixth session of the General Assembly (A/66/PV.11), the President of Argentina, Cristina Fernández de Kirchner, in her address to the General Assembly on 21 September 2011, inter alia, stated with respect to the Falkland Islands (Malvinas) that 10 General Assembly resolutions, 29 resolutions of the Special Committee on decolonization, 11 resolutions and 8 declarations of the Organization of American States, as well as the resolutions of various forums, such as the Ibero-American forums, the Union of South American Nations, the Southern Common Market, and meetings of Arab and African countries had demanded that the issue of sovereignty be addressed.

The Malvinas Islands, South Georgia Islands and South Sandwich Islands and the surrounding maritime areas were unlawfully occupied by the United Kingdom of Great Britain and Northern Ireland, which had expelled the local population and replaced it with its own population, which meant that the right to selfdetermination did not apply to the question of the Malvinas Islands.

The Argentine Republic reiterates its willingness to resume the long-postponed negotiations in order to reach a peaceful solution to the sovereignty dispute over the Malvinas Islands, South Georgia Islands and South Sandwich Islands and the surrounding maritime areas.
