In more than 75 of these cases the excessive or extended use of hand-ties and blindfolds were reported, 62 children reported being beaten, 35 children reported position abuse and 16 children were kept in solitary confinement.

Legislation should protect labour and reflect concepts of social justice and human rights, but it needs to strike a balance as overly cumbersome regulations can make an otherwise viable business unprofitable.

In the capital, the ability of the Liberian National Police to respond adequately in many high crime areas of the capital also remained hampered by the lack of mobility and basic patrol gear.

As defined in the preamble of the Declaration, enforced disappearances occur when persons are arrested, detained or abducted against their will or otherwise deprived of their liberty by officials of different branches or levels of Government or by organized groups or private individuals acting on behalf of, or with the support, direct or indirect, consent or acquiescence of the Government, followed by a refusal to disclose the fate or whereabouts of the persons concerned or a refusal to acknowledge the deprivation of their liberty, which places such persons outside the protection of the law.

Success should be measured in the number of mines destroyed, the amount of land freed from deadly bondage, and the number of survivors who have greater hope that their needs will be met and their rights respected.

So far this ambiguity has also been beneficial in allowing the government to not be bound by the assurances that the foreign ministry has given countries regarding the claims.

With respect to the conditions under which pending cases might be referred, the General Assembly noted the view of the Secretary-General that it would not be desirable to enumerate an exhaustive list of such criteria, as this would unduly bind the discretion of the Dispute Tribunal judges (A/62/782, para. 71).

The usual double standards and the threat by one permanent member to veto any draft resolution aimed at a just and impartial solution had shackled Security Council attempts seriously to address the issue.

But this is not the case and the Director reminded the Council of the frequently uncomfortable institutional situation of the IBE since it is both an integral part of UNESCOand therefore subject to slow bureaucratic procedures and rigid rulesand faced with a new type of management which is based on the mobilization of increasing amounts of extra-budgetary funds, calling for great flexibility and rapidity in relation to donors who have different rules of procedure and requirements.

However, while there may be debate about the scale of the problem, and the degree of inhibition on research incentives, our principal concern is that developing countries avoid where possible the creation of similar problems in their own IPR regimes.

It should also include information on regular independent inspection of places of detention, access to complaints mechanisms by children in detention, specialized standards and norms concerning recourse by personnel to physical restraint and use of force with respect to children deprived of liberty, and the existence of standards and norms concerning disciplinary measures and procedures with respect to children deprived of their liberty.
