Notably, delegations highlighted the following practical measures: the promotion of marine scientific research; the development of codes of conduct for research activities; environmental impact assessments, including the development of guidance on assessments of impacts on marine genetic resources within the general environmental impact assessment process; the establishment of mechanisms for cooperation and the sharing of information and knowledge resulting from research on marine genetic resources, including by increasing the participation of researchers from developing countries in relevant research projects; the establishment of marine protected areas; discussions on practical options for benefit-sharing, including options for facilitating access to samples; and consideration of the intellectual property aspects of marine genetic resources beyond areas of national jurisdiction (A/65/68, para. 73).

Under this item, delegations will be invited to address the issues referred to in paragraph 73 (a) and (b) of General Assembly resolution 59/24, namely: to survey the past and present activities of the United Nations and other relevant international organizations with regard to the conservation and sustainable use of marine biological diversity beyond areas of national jurisdiction; and to examine the scientific, technical, economic, legal, environmental, socio-economic and other aspects of these issues.

Bearing in mind that it is the State party which is responsible for the implementation of the Covenant in all its territories, the Committee urges the State party to ensure the equal enjoyment of the economic, social and cultural rights by all individuals and groups of individuals under its jurisdiction, and recommends that the State party adopt a national strategy for the implementation of the Covenant throughout the State party’s territories.

Efforts should be made to focus more on the primary responsibility of each State to promote and protect the human rights of citizens within its own jurisdiction.

In the sixteenth preambular paragraph of the same resolution, the Assembly also recognized that “there is a need for a more integrated approach and to further study and promote measures for enhanced cooperation, coordination and collaboration relating to the conservation and sustainable use of marine biodiversity beyond areas of national jurisdiction”.

The Department of Health Act (1996) sets out the powers, duties and functions of the Minister which extend to all matters covering the promotion or preservation of the health of Canadians over which Parliament has jurisdiction, including the protection of the people of Canada against risks to health and the spreading of disease, and investigation and research into public health, including the monitoring of diseases.

(a) Full acceptance means that the country concerned will ensure that a product to which the standard applies will be permitted to be distributed freely, in accordance with (c) below, within its territorial jurisdiction under the name and description laid down in the standard, provided that it complies with all the relevant requirements of the standard.

As informal, non-contractual forms of work abound, it is also important to design innovative schemes for the extension of protection to workers that are out of the reach of regulations and laws, including through employment guarantee schemes and social transfers.

(c) Lastly, it should be mentioned once again that Venezuela is not a party to the United Nations Convention on the Law of the Sea and that the fact that it has not objected to the documents adopted at this Conference cannot be interpreted as a change in position in respect of that Convention and its role in the context of a future legal regime applicable to marine resources beyond the areas of national jurisdiction.

He stressed that the standards and measures it had adopted would inevitably provide a benchmark for national measures to protect the marine environment from the harmful effects of seabed activities subject to national jurisdiction, particularly for those countries having insufficient legislative framework.

The common European Union report, submitted separately, covers areas of European Union and European Community competences and activities in relation to Security Council resolution 1540 (2004) and should be read in conjunction with this document.

NEAFC noted its participation as an observer in meetings of the FAO Committee on Fisheries, the United Nations Open-ended Informal Consultative Process on Oceans and the Law of the Sea, the Ad Hoc Open-ended Informal Working Group to study issues relating to the conservation and sustainable use of marine biological diversity beyond areas of national jurisdiction, and informal consultations of States Parties.
