Notably, delegations highlighted the following practical measures: the promotion of marine scientific research; the development of codes of conduct for research activities; environmental impact assessments, including the development of guidance on assessments of impacts on marine genetic resources within the general environmental impact assessment process; the establishment of mechanisms for cooperation and the sharing of information and knowledge resulting from research on marine genetic resources, including by increasing the participation of researchers from developing countries in relevant research projects; the establishment of marine protected areas; discussions on practical options for benefit-sharing, including options for facilitating access to samples; and consideration of the intellectual property aspects of marine genetic resources beyond areas of national jurisdiction (A/65/68, para. 73).

The major challenge encountered in this process has been how to maintain UNESCO’s specificity, hence strength, as a specialized agency with its complex composites of intergovernmental committees with its own political and technical agendas in the promotion of international conventions, normative and standard-setting programmes to serve as exemplars in addressing major global issues in the fields of competence of the Organization.

Under this item, delegations will be invited to address the issues referred to in paragraph 73 (a) and (b) of General Assembly resolution 59/24, namely: to survey the past and present activities of the United Nations and other relevant international organizations with regard to the conservation and sustainable use of marine biological diversity beyond areas of national jurisdiction; and to examine the scientific, technical, economic, legal, environmental, socio-economic and other aspects of these issues.

The Committee reiterates its previous recommendation (CAT/C/FRA/CO/3, para. 20) whereby compliance with the provisions of article 12 of the Convention requires a derogation from the system of discretionary prosecution, so as to oblige the competent authorities to launch impartial inquiries systematically and on their own initiative wherever there are reasonable grounds for believing that an act of torture has been committed in any territory under its jurisdiction, in order to effectively ensure that the perpetrators of such crimes do not remain unpunished.

Indeed, it was Security Council resolution 1315 (2000), in which the Secretary-General was requested to negotiate an agreement with the Government of Sierra Leone to create an independent special court with jurisdiction over those who bear the greatest responsibility for the commission in Sierra Leone of crimes against humanity, war crimes and crimes under Sierra Leonean law.

While decision 38/64, requesting the country to have a licensing system in operation and to have enacted or improved legislation to phase out ODS consumption, had not been fulfilled to the letter, the amounts to be licensed and the involvement of customs in the same role as under a legally-established system might be interpreted as fulfilling the intent of the decision.
