in that declaration [of Malta], articles 74 and 83 of the Convention are interpreted to mean that, in the absence of any agreement on delimitation of the exclusive economic zone, the continental shelf or other maritime zones, the search for an equitable solution assumes that the boundary is the median line, in other words, a line every point of which is equidistant from the nearest points on the baselines from which the breadth of the territorial waters is measured.

I value the impetus provided to such efforts by the Security Council in its presidential statement of May 2008 on post-conflict peacebuilding (S/PRST/2008/16), as well as by the reference in resolution 1830 (2008) to the need to create conditions conducive to the voluntary, safe, dignified and sustainable return of refugees and internally displaced persons in Iraq.

However, in the event that the conditional interpretative declaration actually “behaves like” a reservation, the question of whether it meets the conditions for the permissibility of reservations does have a real impact on the content (and even the existence) of treaty relations.
