Thousands of children are subjected to deprivation of liberty, frequently used as a first option rather than a measure of last resort; they risk torture, abuse and humiliating treatment, including when placed in pretrial detention, and endure violence as a form of control, discipline or punishment; in some countries, sentencing can include caning, flogging, stoning or amputation, as well as capital punishment and life imprisonment without possibility of release.

In his communications to Governments sent from April 2010 to May 2011, the Special Rapporteur expressed concern at a number of situations of alleged violations of the human rights of migrant workers, including (a) arbitrary arrest, sexual violence, torture and other forms of cruel, degrading and inhuman treatment or punishment; excessive use of force; and forced labour; (b) mass expulsions and forcible return; (c) inadequate standard of living, including lack of access to adequate food and housing; (d) sale of children, including for purposes of economic exploitation; (e) killings by border authorities; (f) trafficking for sexual and economic exploitation; (g) verbal and physical abuse by immigration authorities; (h) abuse and exploitation of domestic migrant workers, including denial of basic labour rights, such as non-payment of wages; (i) restrictions on freedom of movement of nationals; and (j) racist and xenophobic propaganda against migrants.

Violence, including torture and humiliating treatment, is used as a form of control, discipline and punishment; in some countries, sentencing can include caning, flogging, stoning or amputation, as well as capital punishment and life imprisonment.

(c) Male children between the ages of 7 and 16 years are subjected to caning and other forms of punishment for many offences in the Penal Code and other laws

Punishment for these offenses includes a maximum 15-year prison term, caning, and a fine, to be determined at the discretion of the sentencing judge.

Consequently, the European Court of Human Rights, in the landmark judgement of Tyrer v. UK, decided in 1978 by a dynamic interpretation of article 3 of the European Convention on Human Rights that birching of a juvenile, a traditional punishment on the Isle of Man, was no longer compatible with a modern understanding of human rights in Europe.

One of the witnesses reported having been sentenced in absentia to five years’ imprisonment for the “encouragement for protests”, one year for disseminating propaganda through media interviews and articles and one year and 74 lashes for “acting against the regime by means of participating in peaceful demonstrations”.

What a shame! I believe that you still remember how the US Government strived for fair and humane treatment of its critizens as illustrated in the case of an American teenager sentenced to flogging in Singapore.

Algeria recommended that Saudi Arabia, (a) in examining the recommendations, take into consideration those that are in line with its religious, social and cultural specificities, in particular those emanating from the Shari’a, which adds to general human rights principles without replacing them; (b) go ahead with its intention to examine the ratification of some international human rights instruments; (c) further its efforts to fight terrorism and protect human rights at the same time, especially support for the conclusion of a comprehensive international treaty to combat terrorism; (d) continue its efforts to create a positive working environment for all migrant workers in the Kingdom.

Luxembourg expressed concern at the deterioration in the human rights situation, characterized by increasing restrictions on the freedom of expression and information; an increase in the number of death penalty convictions, including of minors; convictions involving inhuman and degrading treatment, such as whipping and amputation; the harassment and repression of human rights defenders; the intensification of the repression of women’s-rights activists; and the situation of minorities, particularly ethnic and religious minorities.
