The illegitimate occupation by the United Kingdom of Great Britain and Northern Ireland led to the adoption by the General Assembly of resolutions 2065 (XX), 3160 (XXVIII), 31/49, 37/9, 38/12, 39/6, 40/21, 41/40, 42/19 and 43/25, in which it recognizes the existence of a sovereignty dispute regarding the “Question of the Falkland Islands (Malvinas)” and urges the Governments of Argentina and the United Kingdom of Great Britain and Northern Island to resume negotiations in order to find as soon as possible a peaceful and lasting solution tothe dispute.

Ultimately, the ability to manage relations in the South China Sea and resolve disputes will present a major test of China’s peaceful rise.

I have the honour to enclose herewith a letter dated 6 June 2010 addressed to you by Sheikh Hamad bin Jassim bin Jabr Al-Thani, Prime Minister and Minister for Foreign Affairs of the State of Qatar (see annex), with its enclosure, the Agreement concerning peaceful settlement of the border dispute between the State of Eritrea and the Republic of Djibouti, signed on 6 June 2010 by the President of the State of Eritrea and the President of the Republic of Djibouti, and signed on behalf of the State of Qatar as mediator and witness by His Highness Sheikh Hamad bin Khalifa Al-Thani, Emir of the State of Qatar.

The Act lays down tasks in implementing and promoting the principle of equal treatment, as well as a procedure for settling discrimination disputes.

At the same meeting, speaking on behalf of the Rio Group, the representative of Chile: reiterated the Group’s support for the legitimate rights of Argentina in the sovereignty dispute withthe United Kingdom; recalled its declaration and special communiqué on the exploration for fossil fuels on the continental shelf around the Islands, adopted by the Heads of State and Government of Latin America and the Caribbean gathered at the Unity Summit held in Mexico on 22 and 23 February 2010; rejected the military activities of the United Kingdom in the Islands, which ran counter to the region’s policy of seeking a solution to the dispute through peaceful means; and also recalled the declaration on that matter that had been adopted in Santiago in October 2010 (see A/C.4/66/SR.2).

How it is eventually resolved will have major implications for the role of ASEAN itself.

A previous such meeting that took place in Paris from 29 to 31 May 2000, considered eight principles for the settlement of such disputes originally proposed by Dr Lyndel V. Prott, the then Director of the International Standards Unit of the Division of Cultural Heritage of UNESCO, in her personal capacity at the January 1995 New York symposium “The Spoils of War – World War II and its Aftermath: The Loss, Reappearance and Recovery of Cultural Property”.

It was a principle set forth in the 1970 Declaration on Principles of International Law concerning Friendly Relations and Cooperation among States in accordance with the Charter of the United Nations (General Assembly resolution 2625 (XXV), annex) and was further elaborated in the Manila Declaration on the Peaceful Settlement of International Disputes, approved in 1982 (General Assembly resolution 37/10, annex).

During 2009 and 2010, Argentina and the United Kingdom reiterated their respective positions regarding the sovereignty dispute, including by Argentina through the issuance of press releases on 10 June 2009 in connection with the observance of the “Day of Affirmation of Argentine rights over the Malvinas Islands” and other areas, and on 3 January 2010 “on the occasion of the latest anniversary of the illegal occupation of the Malvinas Islands by the United Kingdom”, and by the United Kingdom through written demarches at the United Nations rejecting territorial and other claims made by Argentina.

In its latest evolutionary stage, it offers state-of-the-art, powerful engines, a further improved range of luxurious appointments and the very latest safety features, as well, of course, as its now legendary off-road capabilities.

Bearing in mind the fundamental principle of the international legal system that States settle their differences through peaceful means, we can only agree with the Outcome Document of the 2005 World Summit (General Assembly resolution 60/1) and recognize once again the important role of the Court in those peaceful settlements.

In particular, General Assembly resolution 2065 (XX), inter alia, and all the decisions of the Special Committee on Decolonization, recognized the existence ofadispute between the Argentine Republic and the United Kingdom as the sole parties concerning sovereignty, establishing that the way to resolve it was through the resumption of bilateral negotiations in order to find a just, peaceful and definitive solution, taking into account the interests of the population of the Islands; the right to self-determination was not, therefore, applicable to that question.

For its part, UNMIK should strengthen the mechanisms for settling disputes between parties with a view to guaranteeing the political, economic and social development of the people of Kosovo, stressing in particular respect for the human rights of minorities.
