Following a period of peace and social calm obtained during recent years through countless sacrifices made by the people of Guinea-Bissau, it is not acceptable that a group of individuals, motivated by personal and narrow-minded interests devoid of any politically justifiable or legal bases, should resort to creating conditions for the return of instability in our country.

The case law has specified that, on the one hand, the abolition of posts should be justified solely by the considerations of the organization and cannot, on any account, serve as a pretext for disguised sanctions, even if criticism of the staff members concerned might have been justified, and on the other hand that the administration was obliged to give each staff member whose post has been abolished all necessary explanations and also to offer him/her a new post matching his/her profile as closely as possible.

The sponsors of the draft resolution themselves lacked defensible human rights records.

Should the counsel determine that the case has legal merit and will be receivable by the Tribunals, he or she provides legal advice to the staff member and may take, inter alia, any of the following actions on behalf of the staff: (a) draft legal submissions and other correspondence; (b) upon authorization from the staff member, engage in discussions with third parties or opposing counsel on case management issues or with a view to negotiating settlements; and (c) represent the staff member in hearings before the Dispute Tribunal.

The Court, held in this regard that the grounds for challenging an arbitrator resemble those for the challenge of a state court judge pursuant to Sec. 42 CCP (challenge of a state court judge), which requires the challenging party to establish at least a good case for the lack of confidence in the arbitrator’s impartiality.

The events to which I have referred underscore the need for continued political efforts to help develop a legally correct and fair resolution of the Kosovo issue in line with resolution 1244 (1999).

We should commit to increasing the autonomy of patients so they can define their objectives, especially in cases of multimorbidity, where a narrow biomedical approach is no longer justified.

In that regard, the objectives of sanctions regimes should be clearly defined, and their imposition should be for a specific time frame and should be based on tenable legal grounds and be lifted as soon as the objectives are achieved.
