The Commission may also wish to consider that, while all options have advantages and disadvantages and no option is perfect, any positive elements of the hybrid approaches in options C and D, are either already covered by or may be covered in options A and B, without multiplying the options and creating an additional level of complexity, which may undermine the certainty and predictability sought to be achieved by a conflict-of-laws rule.

The actual condition of affairs can scarcely be formulated in these terms, however, since the divergencies consist, for the most part, of mere variants in certain sentences, or in the fact that there were different authors and transmitters of them; and although many of these deviations are cited by R. The Organization’s assumption that media, and increasingly ICTs, can serve as platforms for cultural self-expression, mutual understanding and tolerance has proved correct and the ongoing activities have been linked with those of the Alliance of Civilizations led by the United Nations.

As regards the distribution of the fund, Mexico, speaking as the Coordinator for the Latin America and the Caribbean, expressed the concern of the Region that the current allocation of the fund did not correctly reflect the need of the countries of the Region.

These include, inter alia, market drivers (for example, very specific market windows that require the appropriate combination of technical and business skills to access fully); consumer issues (for example, importing markets requiring specific certifications impacting production practices); infrastructure and installed capacity (for example, sufficient airfreight, cold room facilities); and large enough consumption of a given material or product to develop a market for it and ensure availability, and others.

In the view of the Coordinator, shared by his interlocutors, it could become the focus of an effective functional mechanism that would set clear benchmarks for achieving progress in the search for missing persons, referred to in my comprehensive report (S/2009/190, para. 16).

These matters include the questions whether: (a) the grantor has to be the same person as the borrower; (b) the security agreement secures all the relevant obligations; (c) the security right is subject to any legal restrictions; (d) there must be a clear payment schedule in the credit; (e) there are any special rights or obligations (such as rights of way or rights of access to a site); (f) there are any special obligations for the preservation of encumbered assets; (g) there are any obligations not to transfer the encumbered asset or create another security right in it; (h) ways in which the grantor and other interested parties could be notified in the case of default and enforcement; (i) there should be a reference to extrajudicial enforcement; and (j) there should be a dispute resolution clause.

This should include, as part of the month-end finance procedures, the reperformance of a sample of bank reconciliations to assure management that reconciliations are timely and accurate and that items requiring reconciliation have been properly resolved.

The view was expressed that satellite operators would welcome information on space weather hazards and conjunction risks on a daily basis and that expert groups B and C should consider means by which satellite operators could access space weather information and exchange orbital parameters to allow the most accurate risk analysis possible to be performed.
