After discussion, the Working Group agreed that the questions for further consideration on that matter would include (A/CN.9/717, para. 143): (i) whether a provision on protection of the integrity of the arbitral process should be in the form of a general formulation or should contain specific instances that were meant to be specifically addressed; (ii) the interplay between the protection of the integrity of the arbitral process and the provisions in the UNCITRAL Arbitration Rules already dealing with that issue; and (iii) how to determine the threshold for a limitation to transparency based on the ground of the need to protect integrity of the arbitral process.

Those alternatives were (a) to distribute the percentage points arising from the low per capita income adjustment to all Member States; (b) to allow “indirect redistribution” similar to the debt burden adjustment, whereby the GNI of countries below the threshold would be reduced to the extent of the low per capita income adjustment while countries above the threshold would not have to explicitly absorb the relief given to the countries below the threshold; or (c) to create a neutral zone above and below the low per capita income adjustment threshold whereby Member States falling into that neutral zone would neither benefit from nor absorb relief arising from the application of the low per capita income adjustment as in either (a) or (b) above.

Algeria was saddened that joining the block position of a group of countries, Portugal had not accepted the recommendation of Algeria and many other countries to adhere to a core human rights instrument, the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, although Portugal had long been a country of origin of migrant workers and was well placed to understand the suffering and indignity to which migrants were exposed.

In its report contained in document A/C.5/52/39, the Phase IV Working Group reviewed the rates published in the phase III report and recommended that reimbursement of loss or damage of major equipment resulting from a single hostile action or forced abandonment had to meet a threshold of $250,000 (based on generic fair market value) and that loss or damage of major equipment resulting from transportation arranged by the Secretariat had to be more than 10 per cent of the generic fair market value of the equipment.

(d) Competitive bidding thresholds were increased to levels which are more in line with United Nations best practices, in order to reduce the administrative costs and to facilitate the focus on high-value/high-risk contracts.

Israel’s continuation of such illegal policies and practices, in addition to its continuing illegal, inhumane and shameful blockade of the Gaza Strip and the immeasurable suffering and trauma it is inflicting on the 1.5 million civilians imprisoned there, constitutes yet further irrefutable evidence of the occupying Power’s abject disregard for international law, including humanitarian and human rights law, as well as its rejection of the legitimate, inalienable and internationally recognized rights of the Palestinian people to self-determination and freedom in their homeland.

It also recommended that a threshold value be established for “special case” (the generic fair market value of an item or set of items should be higher than $500 and the life expectancy of an item or set of items should be greater than one year) and that the threshold value should be reviewed by the next Working Group.
