The duty to guarantee under international human rights law is far broader than the provision of an effective remedy; guaranteeing the exercise of a right is an obligation of the State not only after a violation occurs but also, essentially, before.

Further to my report pursuant to paragraph 5 of Security Council resolution 1859 (2008) (S/2009/385), once all outstanding activities under the oil-for-food programme are concluded, and taking into account (a) any necessary residual activities, (b) any indemnities that may be provided by the Government of Iraq and (c) the need to ensure the availability of sufficient funds for the Organization to meet the costs and expenses that (i) have been incurred, (ii) are associated with the winding down of the oil-for-food programme and/or (iii) arise from the cooperation of the United Nations with Member States in respect of investigations and proceedings related to the programme, all other remaining funds should be transferred from the Iraq escrow account to the Development Fund for Iraq.

The main objectives of this Commission were the investigation of human rights violations which took place in this period, the discovery of the truth regarding these violations, the identification of the factors which led to them, the identification of the policies and practices which gave rise to them as an instrument for preventing future re-occurrence, the promotion of respect for human rights, the promotion of reconciliation and the support for the process of restoring the dignity of the victims.

It also drew attention to the phenomenon of environmentally induced migration, which affected the most vulnerable populations, and set out concrete responses to that phenomenon, notably the commitment by development partners and the countries concerned to take into account the needs of those whose livelihoods were endangered by climate change and extreme weather events and reduce the incidence of displacement.

There are many other issues that the authorities cannot avoid dealing with, including: ensuring the exchange rate remains stable, but also not overvalued, so as to protect and promote manufacturing and agricultural produc tion; tackling corruption; protecting against the possibility of rising inflation; dealing with rampant land speculation and the potential for land grabbing; and ensuring that new land legislation does not lead to dispossession of small landholders and those holding traditional title.

This could promote land grabbing unless policies are quickly adopted to address this.

In this regard, as it has done before in the Council, Mexico reiterates its deep concern about the violence unleashed over the past 19 days and condemns the Israeli army’s excessive use of force in Gaza, as well as the launching of rockets into Israeli territory from the Gaza Strip by Hamas, which has also resulted in deaths and injuries among the civilian population.

UNESCO’s comparative advantage in research would help assess the incidence of domestic violence in post-disaster situations and suggest policy options for addressing the issue in similar situations in future.

In decision 1983/163, the Council requested the Secretary-General (a) to bring to the attention of intergovernmental and expert bodies, before decisions were adopted, any request for documentation that exceeded the ability of the Secretariat to prepare and process on time and within its approved resources; and (b) to draw the attention of intergovernmental bodies to areas where duplication of documentation was likely to occur and/or where opportunities for integrating or consolidating documents that dealt with related or similar themes might exist, with a view to rationalizing documentation.

The introductory report addressed a number of questions including: terminological issues; the general significance of subsequent agreements and practice in treaty interpretation; the question of inter-temporal law; the relationship between evolutionary interpretation and subsequent agreements and practice; the various elements of subsequent agreements and practice, including: the beginning and the end of the relevant period within which this phenomenon may take place, the identification of a common understanding or agreement by the parties, including the potential role of silence, questions of attribution of conduct to the State; as well as subsequent agreements and practice as a possible means of treaty modification.

Women detainees reported that it was rare for women to be placed in the disciplinary cell, and that, when it happened, it was only for a few days at most.

Specific activities that assisted countries in relation to terrorism targeted at food products included: (a) capacity-building (training courses, projects) concerning food safety, animal and plant health, including promotion of risk analyses and developing base-level capacity to ensure national ability to monitor, diagnose, report and respond to pest and disease outbreaks; (b) the standard setting work of the Codex Alimentarius Commission and the International Plant Protection Convention; (c) the establishment of a Food Chain Crisis Management Framework for prevention, early warning, preparedness and response to food chain crises caused by transboundary animal and plant [...] [...]

The Committee reiterates its previous recommendation (CAT/C/FRA/CO/3, para. 20) whereby compliance with the provisions of article 12 of the Convention requires a derogation from the system of discretionary prosecution, so as to oblige the competent authorities to launch impartial inquiries systematically and on their own initiative wherever there are reasonable grounds for believing that an act of torture has been committed in any territory under its jurisdiction, in order to effectively ensure that the perpetrators of such crimes do not remain unpunished.

In conclusion, on the occasion of Egypt’s presidency of the Group of Arab States for this month, I would like to call for the participation of all United Nations bodies, including the Security Council, in implementing what was called for by the resolution of the League of Arab States adopted on 2 June on the need to protect civilians in Syria and provide the United Nations Supervision Mission with the necessary tools to do that, as well as to take the necessary measures and decisions according to the relevant articles of the Charter of the United Nations in order to put an end to the attacks that are targeting civilians in the Syrian Arab Republic.

In the eight years we have been running IGEL devices they very rarely break down and if something does go wrong, it can be replaced very quickly and the new unit can be up and running in moments.

The main aim of the IAEA verification regime is to prevent the diversion of nuclear material from peaceful activities, to “ensure that special fissionable and other materials, services, equipment, facilities, and information made available by the Agency or at its request or under its supervision or control are not used in such a way as to further any military purpose” (article III A.5 of the Statute) and to reinforce mutual trust and transparency as well as to allow all States parties to the Treaty on the Non-Proliferation of Nuclear Weapons, under secure conditions and with mutual confidence, to exercise their inalienable right to develop research, production and use of nuclear energy for peaceful purposes without discrimination (Treaty article IV).

These matters include the questions whether: (a) the grantor has to be the same person as the borrower; (b) the security agreement secures all the relevant obligations; (c) the security right is subject to any legal restrictions; (d) there must be a clear payment schedule in the credit; (e) there are any special rights or obligations (such as rights of way or rights of access to a site); (f) there are any special obligations for the preservation of encumbered assets; (g) there are any obligations not to transfer the encumbered asset or create another security right in it; (h) ways in which the grantor and other interested parties could be notified in the case of default and enforcement; (i) there should be a reference to extrajudicial enforcement; and (j) there should be a dispute resolution clause.

The Conference also takes note of the proposal that States Parties may need to discuss the detailed procedure for assistance in order to ensure that timely emergency assistance would be provided by States Parties, if requested, in the event of use of biological or toxin weapons.

It was recalled that at the Cartagena Summit, the States Parties recorded that “psychological support, including peer support, is necessary in the immediate aftermath of (an) accident and may be needed at different times throughout the lifetime of the survivor.

A, paragraph 7, of its resolution 65/245, the General Assembly recognized the importance of meetings of regional and other major groupings of Member States for the smooth functioning of the sessions of intergovernmental bodies, and requested the Secretary-General to ensure that, as far as possible, all requests for conference services for the meetings of regional and other major groupings of Member States were met and to inform the requesters as early as possible about the availability of conference services, including interpretation, as well as about any changes that might occur before the meeting.
