This responsibility includes designing, implementing and maintaining internal control relevant to the preparation and the true and fair presentation of financial statements that are free from material misstatement, whether due to fraud or error; selecting and applying appropriate accounting policies; and making accounting estimates that are reasonable in the circumstances.

In establishing a budget for this work plan, the ISU has given due regard for the need to reduce costs and the desire of States Parties that the ISU place a relatively higher priority on certain aspects of its mandate.

When the fair value of unlisted equity securities cannot be reliably measured because (a) the variability in the range of reasonable fair value estimates is significant for that investment or (b) the probabilities of the various estimates within the range cannot be reasonably assessed and used in estimating fair value, such securities are stated at cost less any impairment losses.

Members note that each of the LLP legislation in the provinces of Alberta, Ontario, British Columbia and Manitoba of Canada and the State of Texas of US has a stipulation that removes LLP protection for a partner who has actual knowledge of the default but failed to exercise reasonable diligence to remove it, whereas each of the LLP legislation of the province of Ontario of Canada and the State of Texas of US also has a stipulation to remove LLP protection for a partner who ought reasonably to have known of the default but failed to exercise reasonable diligence to prevent it.

The Advisory Committee also emphasizes the importance of ensuring that Member States receive full assurance from oversight bodies as to the soundness of the management practices and internal controls of the project so as to provide reasonable confidence that the resources appropriated are protected and that institutional objectives are met.

The Executive Committee agrees to approve in principle US $289,548 as the total funds that will be available to achieve commitments stipulated in this document for the complete phase-out of the controlled uses of use of methyl bromide in Zambia, excluding quarantine and pre-shipment applications, subject to the following understandings and considerations.

The expected outcomes under this agenda item include: (a) the identification of emerging issues that merit policy-oriented attention; (b) the identification of progress achieved and gaps requiring priority attention with regard to the implementation of Commission mandates; (c) follow-up actions to major global conferences; (d) the articulation of Asian and Pacific perspectives on issues that will be addressed in major global forums in 2011; (e) the endorsement of the reports of the subsidiary bodies which have been held since the sixty-sixth session of the Commission; and (f) the identification of key issues to be taken up in meetings of subsidiary bodies in 2011.

It stated that substantial assistance and support from the international community to the Comoros was necessary and justified.

The Committee reiterates its previous recommendation (CAT/C/FRA/CO/3, para. 20) whereby compliance with the provisions of article 12 of the Convention requires a derogation from the system of discretionary prosecution, so as to oblige the competent authorities to launch impartial inquiries systematically and on their own initiative wherever there are reasonable grounds for believing that an act of torture has been committed in any territory under its jurisdiction, in order to effectively ensure that the perpetrators of such crimes do not remain unpunished.

As (i) the Reserve Reports were issued by licensed evaluator on the list of Ministry of Land and Resources of the PRC under Geology and Mineral Resources Industry Standard of the PRC, (ii) the Valuer has the relevant experiences and qualification to understand the Reserve Report based on our assessment stated in the paragraphs headed ‘‘Profile of the Valuer and the valuation standards adopted by the Valuer’’ and the representation from the Valuer and (iii) the Valuer has conducted due diligence regarding the Reserve Reports, we consider as stated above that it is justifiable for the Valuer to adopt the information of the Reserve Reports and use the multi-period excess earnings method in forming his opinion on the fair value of the mining right.

(e) To diversify legal aid service providers by adopting a comprehensive approach, for example, by encouraging the establishment of centres to provide legal aid services that are staffed by lawyers and paralegals and by entering into agreements with law societies and bar associations, university law clinics and non-governmental and other organizations to provide legal aid services.

In response, it was stated that the concern about equal treatment of right holders was not valid, since: (a) the rule under discussion addressed the issue of the law applicable to security rights and not the substantive rights of right holders; (b) European Union Member States already followed that approach and there was no issue of them being in violation of the IPR Enforcement Directive; (c) such an approach would be justified on the basis of expectations of the parties to security agreements (not intellectual property right holders) associated with existing intellectual property registries; and (d) the Guide already followed that approach with respect to tangible assets (see recommendations 203 and 205).

In paragraph 2 (b) of Article 4, the Convention requires each party to take the appropriate measures to “ensure the availability of adequate disposal facilities for the environmentally sound management of hazardous or other wastes, that shall be located, to the extent possible, within it, whatever the place of their disposal”, while in paragraph 2 (c) it requires each party to, “ensure that persons involved in the management of hazardous wastes or other wastes within it take such steps as are necessary to prevent pollution due to hazardous wastes and other wastes arising from such management and, if such pollution occurs, to minimize the consequences thereof for human health and the environment”.

Conduct a gender analysis of a programme or project concept to reveal whether gender equality objectives are articulated in the initial idea, whether or not the planned activity will contribute to or challenge existing inequalities, and whether there are any gender issues that have not been addressed.

This occurs if the organization is considered to be a component of the international community to which the obligation is owed or if the obligation breached is owed to the organization because of special circumstances, for instance because force is used in relation to a territory that the organization administers.

The benchmarks adopted so far include: (a) adoption of a formal ERM policy since 2008; (b) an active enterprise risk management committee chaired by the Associate Administrator; (c) a formal implementation strategy for the adoption of ERM in UNDP; (d) dedicated training of staff on the policies and toolkits for ERM (e) clear procedures for the identification, reporting and escalation of relevant risks through the reporting lines for consideration by the ERM committee; (f) dedicated resources for monitoring of and follow up on the corporate risks log; (f) an enabling system for the reporting and review of unit-level and corporate risk; (h) progressively integrated risk-informed and results-based unit work-planning and reporting processes; (i) a planned and periodic review of ERM policies and practices; and (j) contributions to inter-agency experience exchange and learning based on the ERM experiences of UNDP.

One member remarked that the reason for implementation delays was not provided, and asked that future reports contain some analysis of the most important reasons for delays in order to be able to provide recommendations for the Executive Committee, if relevant, on possible ways of further reducing such delays.

Registration should contain the identity of the detainee, the date, time and place of the detention, the identity of the authority that detained the person, the ground for the detention, the date and time of admission to the detention facility and the state of health of the detainee upon admission and any changes thereto, the time and place of interrogations, with the names of all interrogators present, as well as the date and time of release or transfer to another detention facility.

Regarding funding support for the arts groups, members in generally considered that the Administration should (a) ensure a reasonable and fair distribution of funding resources amongst arts groups; (b) review the existing mode of subsidy for the major performing arts groups to avoid stifling the development of non-subvented commercial arts groups; (c) provide more funding for the support of small and medium sized arts groups and budding artists; (d) explore means to minimize staffing and administrative expenses in the operation of arts programmes so that the savings could be re-allocated to the use of arts development; (e) examine the effectiveness of the current funding policy in achieving the policy goals, such as encouraging diversified and balanced development of arts and culture; and (f) consider increasing its overall allocation of funding for culture and the arts, given the imminent need to achieve the vision of the West Kowloon Culture District project.
