Section II, title X, article 328 of the Family Code states: “When the health, safety, morality or education of a minor are jeopardized or insufficiently protected owing to the immoral behaviour or disability of the father and mother or of the person accorded the right of guardianship, or when, owing to misconduct or unruly behaviour, a minor gives these individuals cause for very serious dissatisfaction or renders them incapable of exercising guidance, the juvenile judge may on his own initiative, at the behest of the public prosecutor or at the behest of the father, mother or guardian, rule that the minor shall, for a period not to extend beyond the date of his coming of age, be visited regularly by a social worker or placed on probation.

This should include support for efforts to promote literacy, including functional literacy, formal and non-formal education, beginning with early childhood and continuing on a lifelong basis, education in the mother tongue in the early stages of learning, values education including social and moral awareness, the development of a culture of dialogue, a commitment to a culture of peace, education for sustainable development, teacher training, technical and vocational education and training (geared towards enhancing employability and drawing on the expertise of UNEVOC) as well as science and technology education.

Ms. S. C. CHEUNG continued that, in connection with the plasticiser contamination incident, there were six Section 78B Orders under Section 78C(3) of the Public Health and Municipal Services Ordinance (PHMSO), Cap. 132, issued to recall food from the market or to prohibit the tainted foods from importing and supplying within Hong Kong for which risk assessment showed that long-term consumption of such products may pose a health risk.

Persons belonging to national minorities have the right to free use of their mother tongue, both in written and orally, to have access to information in this language, to disseminate it and to exchange information; the right to organise mass media, to publish literature in the language of national minorities; to determine their attitude towards religion; to celebrate their national holidays and commemorate their historical events, to participate in the exercise of the rituals of their nations, to use in particular their national symbolic; to use their family name, given name and patronymic, including in official acts, in the form accepted by the mother tongue.

In addition to the fundamental rights guaranteed in the Constitution, the Act further provides for the right to survival and development of children; right to name; right to nationality; right to health and health services, etc; right to privacy; right to parental care, protection and maintenance; right to a child in need of special protection measures; right of the unborn child to protection against harm, etc; right to parental property; right to social activities; rights to social activities; contractual rights of the child; right to opinion; right to education; child’s right to stay with parents; protection from harmful social and customary practices; right of child to be maintained and the right of children to legal aid in all cases.

Most of the children come from families where the parents have been arrested for major crimes or are presently serving jail sentences, have been misplaced or are victims of severe abuse.

The following priorities determine the structure of the National Plan of Action for Children: (1) poverty reduction, (2) quality education for all children, (3) better health for all children, (4) improvement of status and rights of children with disabilities, (5) protection of the rights of children without parental custody, (6) protection of children against abuse, neglect, exploitation and violence and (7) strengthening national capacities to resolve the problems of children.

All persons have therefore the right to express themselves and to create and disseminate their work in the language of their choice, and particularly in their mother tongue; all persons are entitled to quality education and training that fully respect their cultural identity; and all persons have the right to participate in the cultural life of their choice and conduct their own cultural practices, subject to respect for human rights and fundamental freedoms.

The Latin America and the Caribbean region wants to establish that it values, recognizes and commends the Division of Relations with National Commissions and New Partnerships for its work and for achieving considerable improvements in communication, capacity-building and general support to the region.

A number of specific comments were made as follows: the reference of the Code on the Marketing of Breast Milk Substitutes is important; the Code should be generic and focus on the protection of consumers in countries which do not have adequate control measures for food quality; the Code should concentrate on the core provisions in Article 3 and should not be used to resolve issues dealing with compliance, which should be addressed by the CCFICS; the problem of illiteracy in some developing countries may be a challenge in order to provide consumer information and raise their awareness on food safety issues; and the Code should not reiterate existing provisions in Codex texts or the WTO agreements.

The forthcoming 2010 UNICEF report on parental child disciplinary practices in a range of low- and middle-income countries confirms the high prevalence of violent disciplinary methods, but also recognizes that this practice coexists with non-violent discipline; close to 9 in 10 children experience physical punishment and psychological aggression, with higher rates among boys, among children between 5 and 9 years of age and in households where mothers condone corporal punishment and domestic violence; conversely, violent discipline was less prevalent when caregivers were engaged in greater levels of educational and play activities with their children.
