(c) Information technology ($2,644,500), owing to a number of factors, including non-implementation of planned activities for system development by the Office of Information and Communications Technology, vacancies with respect to contractual services personnel associated with ongoing information and communications technology operational support in the Department of Field Support, inadvertent recording of technology charges for the period 2010/11 in the financial period 2011/12 in the Department of Management and non-procurement of software for the new case management system in the Office of Internal Oversight Services owing to deficiencies detected in the testing phase.

The Department of Safety and Security is responsible for the development of a comprehensive United Nations policy regarding the management of critical incident stress, including gender-specific requirements; provision of a rapid response to all critical incidents in field locations and coordination at the field level and at Headquarters, including the death of staff members under malicious circumstances, hostage-taking and evacuations; provision of appropriate stress debriefing and counselling to all affected staff, including on gender-specific issues, and ensuring that such assistance is available; establishing and providing stress management training, including organizing peer helper training in peacekeeping missions and conducting certification training for counsellors in their respective regions, and preparing appropriate stress management training materials for the field; and chairing an inter-agency working group on stress management.

Thus, when an enforced disappearance began before the entry into force of an instrument or before the specific State accepted the jurisdiction of the competent body, the fact that the disappearance continues after the entry into force or the acceptance of the jurisdiction gives the institution the competence and jurisdiction to consider the act of enforced disappearance as a whole, and not only acts or omissions imputable to the State that followed the entry into force of the relevant legal instrument or the acceptance of the jurisdiction.

10.4 Subject to clauses 10.2 and 10.3 and to such extent as permitted by applicable law, we will not be liable under the contract between us or otherwise for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising or for any damage caused by any product or failure of such product to perform and whether caused by tort (including negligence), breach of contract or otherwise.

4.46 You and, in the case of a non-personal client, the Authorized User shall jointly and severally, indemnify us, any Associate, any Information Provider and their respective officers and employees against all liabilities, claims, demand, losses, damages, costs, charges and expenses of any kind (including, without limitation, legal fees on a full indemnity basis) which may be incurred by us or any of the above persons and all actions or proceedings which may be brought by or against us or any of the above persons in connection with the provision of the Internet/Phone Banking Services, the Market Information and/or the Reports or the exercise or preservation of our powers and rights under the provisions of this Clause 4, unless due to the gross negligence or wilful default of us, any Associate, any Information Provider or their respective officers or employees or unless the above sub-clause 4.45 applies.
