He pointed out that neutrality was not always established by treaty and that since the status of neutrality was typically relevant during periods of armed conflict (except “permanent” neutrality which also had effect in time of peace), a reference in the Annex related to draft article 5 was not useful.

Further, the alignment of Development Account-funded projects with the Millennium Development Goals has provided not only a useful strategic focus for the Account, but also a guiding reference for partners and recipients of the projects (ibid., para. 39).

Although information exchange has evidently been encouraged through the projects, involving for example local and regional meetings, study tours, workshops and others, these were repeatedly mentioned as most useful activities.

The Commission took the view that the Asia-Pacific Trade Agreement (APTA) was a useful mechanism for promoting region-wide cooperation and integration, and noted with satisfaction the continuous support of the secretariat for that Agreement.

4.8 The State party asks the Committee to note how similar the facts and situations described by the authors are and to take into account the socio-political and security context at the time; to note that the authors failed to exhaust all domestic remedies; to note that the authorities of the State party have established a comprehensive domestic mechanism for processing and settling the cases referred to in these communications through measures aimed at achieving peace and national reconciliation that are consistent with the principles of the Charter of the United Nations and subsequent covenants and conventions; to find the above-mentioned communications inadmissible; and to request the authors to avail themselves of the appropriate remedy.

The delegation of Thailand also noted that the discussions and recommendations for action from the Asia-Pacific Urban Forum were very useful and should be implemented to promote sustainable urban development in the region, and particularly requested the secretariat to prioritize three areas of work: firstly, to develop criteria and standards for city classification, such as “sustainable city”, “eco-city”, and “green industrial city” to provide a guideline for benchmarking sustainable urban development at the regional and subregional levels; secondly, to develop databases and networks at the regional and subregional levels that would include urban and rural population statistics and economic, social and physical data, including environment and geo-climatic data; and thirdly, to hold a symposium on urban climate change among member States in order to exchange experiences and best practices towards achieving sustainable city development.

At present, if a researcher isolates a gene and is granted a patent, for example, for the use of that gene as a diagnostic for a particular disease, depending upon the precise wording of the claim and the approach that the local law takes to interpretation of the patent, she may be able to assert rights over all uses of that gene, including those as yet undiscovered.

The briefing in this case took an inordinately large amount of time due to the need to translate all Bosnian/Croatian/ Serbian documents into one of the working languages of the Tribunal and all documents in one of the working languages into Bosnian/Croatian/Serbian because of Šešelj’s choice to represent himself.

Some delegations supported a study as it would not commit the Commission to adopt qualified majority voting but could deliver useful information on the impact of such a system on the work of the Commission.

The Conference encourages States Parties to provide appropriate information on any such measures they have taken, as well as any other useful information on their implementation to the Implementation Support Unit within the United Nations Office for Disarmament Affairs.
