In introducing the debate, the representative of the Secretariat looked forward to the reactions and advice of the Executive Board particularly on UNESCO’s roles and modalities of action at country level (re paragraph 17 of the document) and on the set of principles and guidelines to drive the design of UNESCO’s response to the decentralization challenges (re paragraphs 18-22), indicating that all options which will be presented to the Board at its next session will reflect different ways of translating the same set of principles through various different structural adjustments, functional responsibilities, accountabilities and reporting lines.

I reaffirm today that, despite the harsh reality that prevails on all fronts, the Palestinian leadership remains fully committed to peace and to engaging in a credible peace process based on the agreed terms of reference, with the aim of definitively bringing an end to the Israeli occupation in order to allow the Palestinian people to exercise their right to selfdetermination in their independent State, with East Jerusalem as its capital, living side by side with Israel in peace and security on the basis of the pre-1967 borders, and achieving a just resolution of the plight of the Palestine refugees in accordance with international law and United Nations resolutions.

The Company shall not (unless such sanction has been given by the CP Shareholders as would be required for a variation of the special rights attaching thereto or unless otherwise provided in the Bye-laws) create or issue any shares ranking as regards order in the participation in the assets of the Company on a winding up or otherwise in priority to the Convertible Preference Shares and the Company may create or issue, with the prior written consent of the CP Shareholders, shares ranking pari passu in all respects (including as to class) with the Convertible Preference Shares.

He expressed the belief that a UNESCO policy could assist greatly in supporting the rights of indigenous peoples in three main ways: first, by assisting UNESCO to reflect on the effects of its existing programming on indigenous peoples, as part of an evaluative process; second, by assisting UNESCO in its strategic planning for programmes affecting indigenous peoples, incorporating the objective of protecting the rights of indigenous peoples into programmatic work; and third, by providing UNESCO with practical orientation for consultation with indigenous peoples, in relation to UNESCO programmes and activities.

However, the view was expressed that, in considering possible solutions, the feasibility and efficiency of existing options should be examined, and priority given to practical measures that would avoid duplication of efforts and ensure an optimal use of the existing framework.

Regarding funding support for the arts groups, members in generally considered that the Administration should (a) ensure a reasonable and fair distribution of funding resources amongst arts groups; (b) review the existing mode of subsidy for the major performing arts groups to avoid stifling the development of non-subvented commercial arts groups; (c) provide more funding for the support of small and medium sized arts groups and budding artists; (d) explore means to minimize staffing and administrative expenses in the operation of arts programmes so that the savings could be re-allocated to the use of arts development; (e) examine the effectiveness of the current funding policy in achieving the policy goals, such as encouraging diversified and balanced development of arts and culture; and (f) consider increasing its overall allocation of funding for culture and the arts, given the imminent need to achieve the vision of the West Kowloon Culture District project.

As the discussions on reciprocity explained, one side’s unlawful use of civilian shields, for example, does not affect the other side’s obligation to ensure that airstrikes do not kill civilians in excess of the military advantage of killing the targeted fighters.

(3) Where there are joint registered holders of any Share, any one of such persons may vote at any meting, either personally or by proxy, in respect of such Shares as if he is solely entitled thereto, but if more than one of such joint holders be present at any meeting personally or by proxy, that one the said persons so present whose name stands first in the register of members in respect of such Share shall alone be entitled to vote in respect thereof.

That this Council urges the Government to comprehensively review the West Kowloon Cultural District development project, consider the ‘software’ contents before planning the cultural facilities, extend the deadline for submission of development proposals, openly and thoroughly consult the cultural sector, professional bodies, the real estate sector, the Legislative Council, the public and relevant organizations, and uphold the ‘people-oriented’, ‘partnership’ and ‘community-driven’ principles put forward by the Culture and Heritage Commission for the West Kowloon development in formulating a development and operation plan that is open, fair and proper; and in the process of development, the Government should also facilitate a partnership between developers and the cultural sector, so as to allow the latter to participate in the planning and future operation of the facilities in the district.

During their visit, the Working Group found that the challenges faced by people of African descent in Portugal related mainly to their lack of recognition as a specific group in the national policy and legal framework; the lack of recognition of their positive contribution throughout history to the construction and development of the country; the lack of qualitative and quantitative disaggregated data by racial or ethnic origin; the existence of a circle of poverty, unequal access to education, public services, employment, as well as discrimination in the administration and functioning of the justice system; existence of racial profiling and police violence; underrepresentation in political and institutional decision-making processes, as well as the lack of special measures or affirmative action policies in Portugal for people of African descent or other minorities.

In the interpretation of this Memorandum of Association in general and of this Clause 3 in particular no object, business or power specified or mentioned shall be limited or restricted by reference to or inference from any other object, business or power, or the name of the Company, or by the juxtaposition of two or more objects, businesses or powers and that, in the event of any ambiguity in this Clause or elsewhere in this Memorandum of Association, the same shall be resolved by such interpretation and construction as will widen and enlarge and not restrict the objects, businesses and powers of and exercisable by the Company.
