Member States and international organizations, when appropriate, should encourage rightsholders and the lawful beneficiaries of limitations and exceptions to copyright and related rights protection to ensure that such limitations and exceptions are applied in certain special cases that do not conflict with a normal exploitation of the work and do not unreasonably prejudice the legitimate interests of the rights-holders as required for in the WIPO Copyright Treaty (WCT) and the WIPO Performances and Phonograms Treaty (WPPT).

Even though it is not the responsibility of the insurance industry to specify the materials or products to be installed in a home, there is value in knowing what alternatives and solutions exist on the market to help reduce claims and to be able to discuss these options with policy holders who may be experiencing ongoing problems.

These include building effective networks, fostering an enabling environment and establishing principles of engagement for Sectors (e.g. brain-, costand credit-sharing), as well as a strong focus on joint problem solving, especially in field projects, while incorporating traditional knowledge sources.

Based on the above, the Secretariat expressed concerns that the proposed project did not meet the guidelines in decision 58/19, nor does it clearly respond to decision XXI/2 of the Twenty-first Meeting of the Parties to the Montreal Protocol where the Executive Committee was requested, inter alia, “to consider the costs of a one-time window within its current destruction activities to address the export and environmentally sound disposal of assembled banks of ozone-depleting substances in low-volumeconsuming countries that are not usable in the Party of origin”, since the proposal is more of a study to see what are the issues and problems related to ODS waste disposal in this region with a view to finding a future solution.

At this point, and in view of the fact that the Supreme Court had twice declined to consider his application for supervisory review, the author concluded that further attempts to obtain a thorough review of the earlier proceedings were futile, and he pursued no further legal action.
