While no new draft article on the subject was proposed, consideration was given to the basis of the right to appeal, which could be found in both international and domestic law; the time frame for reviewing an appeal; the suspensive effect of remedies; and remedies against a judicial expulsion decision.

As reasons for his failure to appeal, the author submitted that the day before he was to be expelled from Sweden, the Migration Court decided not to stay the enforcement of his expulsion, and that he had good reasons to believe that the Migration Court of Appeal would also reject his request for a stay of enforcement, in view of the fact that the Court of Appeal would probably not grant him leave to appeal.

While recognizing the absence of a customary rule broadly providing for the suspensive effect of an appeal against an expulsion decision, the view was expressed that the Commission should recognize as part of lex lata the suspensive effect of an appeal in which the person concerned could reasonably invoke the risk of torture or ill-treatment in the State of destination.

The text of the decisions was editorially aligned to the decision adopted for the Kernavé Archeological Site (Lithuania), though it should be noted that the decision of referral for the Azerbaijani requests contained references to more paragraphs in the Guidelines than the decision of referral for the Lithuanian request.

According to other members, the Commission should formulate a draft article, if only as part of progressive development, envisaging the suspensive effect of an appeal against an expulsion decision, provided that there was no conflict with compelling reasons of national security.
