When, under the terms of the treaty or by reason of the limited number of the negotiating States and the object and purpose of the treaty, the participation of any other State in the treaty must be considered as requiring the consent of all the parties or of all the contracting States, the newly independent State may establish its status as a party or as a contracting State to the treaty only with such consent.

Later, in the context of the change management effort undertaken by the Secretary-General, various parts of the Secretariat, including ESCAP, have proposed several additional measures to reduce or eliminate the use of paper—including by mass digitizing documents, and revisiting the issue of the need to translate documents—and reduce the number and frequency of meetings.

Other criteria proposed were: contribution to the attainment of the MDGs; degree of relevance vis-à-vis the C/4 strategic objectives and the national priorities of Member States involved; regional or international character with significance for various countries; outreach and impact; contribution to capacity-building in Member States and number of Member States involved; suitability to serve as a source of best practice; and potential for attracting extrabudgetary support.

It was noted, however, that the number of universalisation actors continues to be small and could be considerably reinforced if more States Parties became active.

Turning to the report of the Secretary-General on the proposed budget for the International Tribunal for the Former Yugoslavia for the biennium 2010-2011 (A/64/476), he said that five main developments would affect the Tribunal’s workload in 2010-2011: the continuation of a seventh trial in the first three quarters of 2010; the high complexity of trials and appeals in multiple-accused cases; the completion of seven firstinstance trials during the biennium; an increase in the number and complexity of interlocutory appeals and appeals on merits; and a reduction in first-instance trial activity as from the third quarter of 2010.

While the number of names removed from the List should not be seen as a benchmark of the success of the review, the removal of any name that no longer meets the criteria for listing obviously makes the sanctions regime more relevant to the threat and gives implementation of the sanctions measures more purpose.

As Canada did not wish to suggest specific topics, it referred to the following indicative examples of sub-themes that could be addressed under the proposed “outward-looking” approach, bearing in mind that the number of sub-themes would have to be limited: crime, human rights and the rule of law (that would include both the role of criminal justice in protecting human rights and the role of human rights in the justice system, and the role of the rule of law in both); crime and international peace, security and reconstruction (post-conflict and post-disaster situations); crime and technological change, including cybercrime, as well as the use of technologies by organized criminal groups and for trafficking, among other crimes; and crime and trade, commerce and the global economy (that could cover specific areas of economic crime and possibly corruption).

Some delegates felt that not enough countries were graduating from LDC status, and called on UNCTAD to ensure that its work better reflected changes that had been occurring in developing countries over the previous four decades.

Finally, as a separate but related matter, the commentary may also deal in this context with the question whether the grantor may demand additional information with respect to the debt and whether: (a) the grantor should be entitled to a limited number of responses free of charge within a specified period of time; and (b) the grantor should be entitled to damages or other remedy through a summary judicial or administrative procedure if the secured creditor fails to provide that information.
