3. Notwithstanding the expiration of the period set out in paragraph 1 of this article, one party may rely on its claim as a defence or for the purpose of set-off against a claim asserted by the other party.

Despite such challenges, there were many important accomplishments, including: (a) responding to the majority of the claims brought to the Office, including the provision of summary advice (206 instances), to clients in more than 80 countries; (b) closure or resolution of 54 per cent of the 938 cases filed with the Office of Staff Legal Assistance during the year; (c) a high success rate before the Dispute Tribunal; (d) undertaking outreach to staff in the field; and (e) the development of relationships with internal and external partners, including United Nations staff unions and associations, staff-at-large, the Office of the United Nations Ombudsman and Mediation Services, the legal offices of the Secretariat and United Nations agencies, funds and programmes, law offices providing pro bono legal counsel, schools and universities.

Finally, it was agreed that the commentary should clarify: (a) that, if a security agreement had been concluded but its effectiveness was the subject of a dispute between the secured creditor and the grantor, the grantor could seek to amend or cancel the registration through a summary judicial or administrative proceeding; (b) that recommendation 32, which reiterated the principle reflected in recommendations 16 and 17, was not inconsistent with recommendation 67 (advance registration) of the Secured Transactions Guide; (c) whether the grantor could claim damages for breach of contract or tort by the secured creditor was a matter of other law; and (d) examples of proceedings referred to in recommendation 32.

In the case of insolvency of an employer, unemployment insurance guarantees the payment of at least the minimum of outstanding claims of employees against the employer based on their employment relationship.

The Guest agrees and consents that the Carrier and/or its promotional partners shall have the exclusive right to use and/or include any photographic, video, audio and other visual portrayals of the Guests in any pictorial medium of any nature whatsoever for the purposes of trade, advertising, sales, publicity commercially or otherwise without any liability or compensation whatsoever to the Guest and all rights, title and interest (including all worldwide copyrights) therein shall belong to the Carrier absolutely, free from any claim by the Guest or any person deriving any rights or interest from the Guest.

While the International Tribunals have played an important role by providing a direct form of accountability for perpetrators of gender-based crimes, it is critical that States recognize their responsibility and have the capacity to enforce law, end impunity, prosecute perpetrators of violence and provide redress and compensation to survivors of gender-based violence.

Article 8 whereby the liability of the Carrier for the loss of or damage to cabin luggage shall in no case exceed 833 SDR per passenger per carriage, and in the case of loss of or damage to vehicles including all luggage carried in or on the vehicle, 3,333 SDR per vehicle per carriage, and in the case of loss of or damage to luggage other than those mentioned in this paragraph, 1,200 SDR per passenger per carriage, subject to the full amount deductible as set out in Article 8(4).

Unless, any such dispute, controversy or claim between the Parties arising out of or relating to this Contract or the breach, termination or invalidity thereof is settled amicably under the preceding paragraph of this Article within sixty (60) days after receipt by one Party of the other Party’s request for such amicable settlement, such dispute, controversy or claim shall be referred by either Party to arbitration in accordance with the UNCITRAL Arbitration Rules then obtaining, including its provisions on applicable law.
