At its sixty-second session, the General Assembly requested the Secretary-General to update the compilation of decisions of international courts, tribunals and other bodies referring to the articles, and to invite Governments to submit information on their practice in that regard; also requested the Secretary-General to submit that material well in advance of its sixty-fifth session; and decided to further examine, within the framework of a working group of the Sixth Committee, the question of a convention on responsibility of States for internationally wrongful acts or other appropriate action on the basis of the articles (resolution 62/61).

Notably, delegations highlighted the following practical measures: the promotion of marine scientific research; the development of codes of conduct for research activities; environmental impact assessments, including the development of guidance on assessments of impacts on marine genetic resources within the general environmental impact assessment process; the establishment of mechanisms for cooperation and the sharing of information and knowledge resulting from research on marine genetic resources, including by increasing the participation of researchers from developing countries in relevant research projects; the establishment of marine protected areas; discussions on practical options for benefit-sharing, including options for facilitating access to samples; and consideration of the intellectual property aspects of marine genetic resources beyond areas of national jurisdiction (A/65/68, para. 73).

In the interpretation of this Memorandum of Association in general and of this Clause 3 in particular no object, business or power specified or mentioned shall be limited or restricted by reference to or inference from any other object, business or power, or the name of the Company, or by the juxtaposition of two or more objects, businesses or powers and that, in the event of any ambiguity in this Clause or elsewhere in this Memorandum of Association, the same shall be resolved by such interpretation and construction as will widen and enlarge and not restrict the objects, businesses and powers of and exercisable by the Company.

In section V, paragraph 11, of the same resolution, the General Assembly requested the Secretary-General to seek a more effective strategy to fill current and future language post vacancies at all duty stations in a timely manner, took note of paragraph 92 of the report of the Secretary-General on the pattern of conferences (A/63/119 and Corr.1), and also requested the Secretary-General to hold the competitive examinations for the recruitment of language staff referred to in that paragraph, as well as other examinations beyond 2009, well in advance so as to fill current and future language post vacancies at all duty stations in a timely manner, and to inform the Assembly at its sixty-fourth session of efforts in that regard.

As in Babli, they frequently have only a slight bearing, sometimes none at all, on the subject of the mishnaic section and its Talmudic interpretation, being added to the passages in which they are found either because they were mentioned in the academy on account of some subject under discussion, or because, in the process of the redaction of the treatise, this haggadic material, which was valued for some special reason, seemed to fit into the Talmudic text at the passage in question.

Under this item, delegations will be invited to address the issues referred to in paragraph 73 (a) and (b) of General Assembly resolution 59/24, namely: to survey the past and present activities of the United Nations and other relevant international organizations with regard to the conservation and sustainable use of marine biological diversity beyond areas of national jurisdiction; and to examine the scientific, technical, economic, legal, environmental, socio-economic and other aspects of these issues.

Taking the above into consideration, we can enumerate some of the entities that fulfil the requirements of the statute to be regarded as public entities including: the organs of public authorities, including organs of government administration; state control, law enforcement bodies and their associations; municipality; country and provincial authorities; entities financed by the state; and the local government (including other central or local government legal people created under separate legislation for the purpose of performing public tasks), with the exclusion of enterprises, banks and commercial companies.

While welcoming the Secretary-General’s report (A/66/220) on development cooperation with middleincome countries, CARICOM States were disappointed that it did not refer to the fact that the small island developing States in that category were open, vulnerable and heavily indebted, with deep and intractable pockets of poverty, and required assistance from the international community, including debt relief, concessions and assistance specifically tailored to increase economic and developmental space, in order to cope with their situation.

Consideration of each annual review in the General Assembly and the Economic and Social Council should include, inter alia, (a) follow-up, monitoring and assessment of progress in the implementation of the Programme of Action at the national, subregional, regional and global levels through reporting by Governments, as well as by the secretariats and intergovernmental bodies of the United Nations system and of other relevant subregional, regional and international organizations and institutions; (b) fostering international cooperation in support of the Programme of Action, including coordination among donors and among organizations referred to above; and (c) elaborating new policies and measures in the light of changing domestic and external circumstances facing least developed countries.

The Delegation of India, referring to its written comment presented in CAC/31 LIM/9, stated that the selection of cultivars to achieve a reduced sugar content level of less than 0.3 % in raw potatoes was not always feasible and that strict control of storage temperature and time was not always possible, particularly in developing countries.

As they produce effects almost identical to those produced by reservations, these techniques nevertheless deserve to be mentioned in the part of the Guide to Practice devoted to the definition of reservations, if only so as to identify more clearly the key elements of the concept, distinguish them from reservations and, where applicable, draw appropriate conclusions with regard to the legal regime of reservations.

In the context of international efforts for counter-piracy and the participation of military personnel in the operations referred to in article 4, para. 13 of this decree, and also in conjunction with the European Union Joint Action 2008/851/PESC of the Council, of 10 November 2008, and awaiting the approval of the guidelines of the Maritime Safety Committee of the United Nations within the International Maritime Organization (IMO), it is authorized — whereas the detachments referred to in para. 1, are not established — and in any case within the limits established in paras. 5, 5-bis, 5-ter, the employment of “sworn guards”, authorized under articles 133 and 134 of the Unified law text on Public Security, approved with Royal Decree 18 of June 1931, No. 773, on board merchant ships flagged in Italy transiting in international waters referred to in para. 1, for the protection of the said ships.

In the Salvador Declaration, the States Members of the United Nations invited the Commission, in coordination with the relevant United Nations bodies, to study the nature of the challenge concerning emerging forms of crime that have a significant impact on the environment and ways to deal with them effectively (para. 14); invited the Commission to consider reviewing the issue of international cooperation in criminal matters and explore the need for various means of addressing identified gaps (para. 21); and invited the Commission to consider requesting UNODC to design and provide to States specific technical assistance programmes to achieve the aims in the area of juvenile justice mentioned in the Declaration (para. 30).

These matters include the questions whether: (a) the grantor has to be the same person as the borrower; (b) the security agreement secures all the relevant obligations; (c) the security right is subject to any legal restrictions; (d) there must be a clear payment schedule in the credit; (e) there are any special rights or obligations (such as rights of way or rights of access to a site); (f) there are any special obligations for the preservation of encumbered assets; (g) there are any obligations not to transfer the encumbered asset or create another security right in it; (h) ways in which the grantor and other interested parties could be notified in the case of default and enforcement; (i) there should be a reference to extrajudicial enforcement; and (j) there should be a dispute resolution clause.

Those provisions include the reference to the Final Document (resolution S-10/2) of the first special session of the General Assembly devoted to disarmament (SSOD-I); NAM summit statements; the advisory opinion of the International Court of Justice; the goal of eliminating nuclear weapons within a specified framework of time; the role and work of the Conference on Disarmament, including the establishment of an ad hoc committee on nuclear disarmament in the Conference as a high priority; as well as the call to convene an international conference on nuclear disarmament in all its aspects at an early date to identify and deal with concrete measures of nuclear disarmament.

Finally, with regard to the baseless allegations made this morning against my country, in particular by the representative of the Israeli regime, I would like to mention that the representative of the Israeli regime, in line with the regime’s warmongering and propaganda campaign against my country, has once again used this body to level baseless allegations against Iran.

They considered that in order for UNESCO science programmes to make a significant difference, the Organization should act as a facilitator of global, regional- and countrylevel science policy development by improving the base of relevant scientific research knowledge and communicating that knowledge, by promoting policy work and participating in formulating policy advice, as well as by building country capacity in policy making and scientific monitoring and benchmarking.

They are (a) a secretariat team to provide effective secretariat support to the Special Committee; and (b) a research and consultation team to provide policy support and co-ordinate policy formulation which includes: conducting further in-depth research of working hours systems, proposing further assessments of the implications of the working hours policy for various aspects of the economy, studying measures related to specific sectors with special working hours patterns or arrangements, supporting the Special Committee to conduct consultations, launching public awareness and education campaigns, and promoting public understanding of SWH-related measures.

With respect to the availability of and accessibility to appropriate services for landmine victims, Serbia reported that all survivors in the Republic of Serbia are integrated within the country’s health care system at all levels including in emergency medical care, treatment, physical therapy and rehabilitation, and supplying prosthetic and orthotic aids.

The use of ICT applications for community empowerment was also mentioned by several Member States to receive special attention in programmes dealing with the development of communication and traditional media; the promotion of press freedom and media pluralism; community broadcasting; and the promotion of local content.

An informal working group had been established, and with a view to strengthening the role and effectiveness of the Advisory Committee, member States had proposed some changes to its terms of reference.

The delegation of Thailand also noted that the discussions and recommendations for action from the Asia-Pacific Urban Forum were very useful and should be implemented to promote sustainable urban development in the region, and particularly requested the secretariat to prioritize three areas of work: firstly, to develop criteria and standards for city classification, such as “sustainable city”, “eco-city”, and “green industrial city” to provide a guideline for benchmarking sustainable urban development at the regional and subregional levels; secondly, to develop databases and networks at the regional and subregional levels that would include urban and rural population statistics and economic, social and physical data, including environment and geo-climatic data; and thirdly, to hold a symposium on urban climate change among member States in order to exchange experiences and best practices towards achieving sustainable city development.

The Executive Committee encourages the Philippines to continue its path towards complete phase-out of Annex A and B substances in 2010 through completion of its national CFC phase-out plan, ongoing monitoring and public awareness raising activities; and, effective enforcement of policies to reduce incidences of illegal ODS trade, and early action to initiate activities for HCFC phase out.
