That this Council urges the Government to comprehensively review the West Kowloon Cultural District development project, consider the ‘software’ contents before planning the cultural facilities, extend the deadline for submission of development proposals, openly and thoroughly consult the cultural sector, professional bodies, the real estate sector, the Legislative Council, the public and relevant organizations, and uphold the ‘people-oriented’, ‘partnership’ and ‘community-driven’ principles put forward by the Culture and Heritage Commission for the West Kowloon development in formulating a development and operation plan that is open, fair and proper; and in the process of development, the Government should also facilitate a partnership between developers and the cultural sector, so as to allow the latter to participate in the planning and future operation of the facilities in the district.

In addition, the ICBL noted that many efficiency issues they have raised touch upon the role of the United Nations and, in this regard, expressed appreciation for a constructive dialogue that has started in recent months between non-governmental organisations and the UN.

The mandate of the Commission is to decide through binding arbitration all claims for loss, damage or injury by one Government against the other, and by nationals (including both natural and juridical persons) of one party against the Government of the other party or entities owned or controlled by the other party that are (a) related to the conflict that was the subject of the Framework Agreement, the Modalities for its Implementation and the Cessation of Hostilities Agreement, and (b) result from violations of international humanitarian law, including the 1949 Geneva Conventions, or other violations of international law.

At the 10th meeting, on 16 October, the representative of India, on behalf of Afghanistan, Albania, Armenia, Bangladesh, Belgium, Bhutan, Bulgaria, Cambodia, Chile, Croatia, the Czech Republic, El Salvador, Estonia, Finland, France, Germany, Greece, Guatemala, Haiti, Honduras, Hungary, India, Ireland, Italy, Kuwait, Latvia, Lithuania, Luxembourg, Mauritius, Monaco, Myanmar, Nepal, the Netherlands, Norway, the Philippines, Poland, Portugal, Romania, the Russian Federation, Samoa, Serbia, Singapore, Slovakia, Spain, Sri Lanka, Thailand, the former Yugoslav Republic of Macedonia, Togo, Turkey and the United Kingdom of Great Britain and Northern Ireland, introduced a draft resolution entitled “Measures to prevent terrorists from acquiring weapons of mass destruction” (A/C.1/63/L.34).

The Advisory Committee recalls that in document A/64/6 (Sect. 34), the Secretary-General submitted a preliminary proposed programme budget for section 34 ofthe regular budget and the gross budget for jointly financed activities, pending the completion of the comprehensive management review of the organization of the Department of Safety and Security that was recommended in June 2008 by the Independent Panel on Safety and Security of United Nations Personnel and Premises Worldwide and the submission of the response of the United Nations System Chief Executives Board for Coordination to the recommendations of the Independent Panel.

It was suggested that the States Parties reflect on how they can enable the necessary in-depth analysis and discussion of the requests in order to ensure that high quality requests continue to be the norm.

43 At the trial or hearing ofany action or other proceedings for the recovery ofany money due for any call,it shall be sufficient to prove that the name of the member sued is entered in the register as the holder, or one of the holders, of the shares in respect of which such debt accrued; that the resolution making the call is duly recorded in the minute book; and that notice of such call was duly given to the member sued, in pursuance of these Articles; and it shall not be necessary to prove the appointment of the Directors who made such call, nor any other matters whatsoever, and the proof of the matters aforesaid shall be conclusive evidence of the debt.

The representative of the Secretariat said that the World Bank had submitted a request for the release of the fourth and last funding tranche of US $1,767,000 plus agency support costs for the 2009 implementation programme for phasing out use of CFC-11 in the polyurethane foam sector in China.

The Board may appoint any person to sign on behalf of the persons entitled to share in a capitalisation issue any agreement with the Company necessary or desirable to give effect thereto and such appointment (and any agreement made pursuant to such appointment) shall be effective and binding upon all concerned, and the contract may provide for the acceptance by such persons of the shares, debentures or other securities to be allotted and distributed to them respectively in satisfaction of their claims in respect of the sum so capitalised.

At its sixty-fourth session, the General Assembly requested the Scientific Committee to continue its work, including its important activities to increase knowledge of the levels, effects and risks of ionizing radiation from all sources; requested the Scientific Committee to continue at its next session the review of the important questions in the field of ionizing radiation andto report thereon to the Assembly at its sixty-fifth session; and resolved to take a decision on the membership of the Scientific Committee once a decision on resource allocation had been made and after the fifty-seventh session of the Scientific Committee but no later than the end of the sixty-fourth session of the General Assembly (resolution 64/85).

The delegation also noted that the Special Rapporteur had identified a number of areas of concern, including the need to develop binding national guidelines to address land reform; making the legislative process more transparent by sharing draft legislation with an impact on human rights issues with the wider community; and creating a Government and civil society forum to foster an environment of cooperation to strengthen democracy and human rights in the country.

Moreover, meetings of the Committee on Conferences may be required in compliance with paragraph 6 of resolution 35/10 A, by which the General Assembly decided that all proposals affecting the schedule of conferences and meetings made at sessions of the Assembly are to be reviewed by the Committee when administrative implications are being considered under the requirements of rule 153 of the rules of procedure of the Assembly.

The control system may include fines together with warning notices and suspension of transport permits.

Following a discussion, the Executive Committee decided to approve the pilot project for validation of methyl formate as a blowing agent in the manufacture of polyurethane foam (phase I) in Brazil at a total cost of US $401,500 plus agency support costs of US $30,113 for UNDP, noting that the project was consistent with decision 55/43(e) and that it had been designed to disseminate the results from the validation of methyl formate technology in rigid and integral skin polyurethane foam applications globally, and on the understanding that the project would be the final validation project for methyl formate in the manufacture of rigid and integral skin polyurethane foams, and that approval of the project was without prejudice to consideration of the future funding request for phase II of the project by the Executive Committee.

They invoke entirely new grounds against their expulsion to Afghanistan: first, that they sought asylum in Sweden, which is considered to be a serious crime in Afghanistan; second, that the first complainant is registered with the Afghan secret police because of having worked as an interpreter for asylum-seekers in Sweden; third, that some of their father’s old enemies are officials in the present Government and they will be killed because their name is known.

(C) To the extent permitted by and subject to due compliance with all applicable laws, rules and regulations and to obtaining all necessary consents, if any, required thereunder, the requirements in paragraph (B) of this Article shall be deemed satisfied in relation to any person by sending to the person in any manner not prohibited by the Ordinance and instead of a copy of the Relevant Financial Documents, a summary financial report derived from the Relevant Financial Documents which shall be in the form and containing the information required by applicable laws, rules and regulations, provided that any person who is otherwise entitled to the Relevant Financial Documents may, if he so requires and in accordance with the Ordinance and all other applicable laws, rules and regulations, by notice in writing served on the Company, demand that the Company sends tohim, in addition to a summary financial report, a complete printed copy of the Relevant Financial Documents.

At that session, the Commission agreed that: (i) any future review should be based on the previous deliberations on the subject in the Commission, the observations by France and the United States (A/CN.9/635 and A/CN.9/639, respectively), and the note by the Secretariat (A/CN.9/638 and addenda), which was considered as providing a particularly important historical overview of the establishment and evolution of UNCITRAL rules of procedure and methods of work; (ii) the Secretariat should be entrusted with the preparation of a working document describing current practices of the Commission with the application of rules of procedure and methods of work, in particular as regards decision-making and participation of non-State entities in the work of UNCITRAL, distilling the relevant information from its previous note (A/CN.9/638 and addenda); this working document would serve for future deliberations on the subject in the Commission in formal and informal settings.

(4) Subject to any provision to the contrary in these Bye-laws the Members may, at any general meeting convened and held in accordance with these Bye-laws, by ordinary resolution remove a Director at any time before the expiration of his period of office notwithstanding anything in these Bye-laws or in any agreement between the Company and such Director (but without prejudice to any claim for damages under any such agreement) provided that the notice of any such meeting convened for the purpose of removing a Director shall contain a statement of the intention so to do and be served on such Director fourteen (14) days before the meeting and at such meeting such Director shall be entitled to be heard on the motion for his removal.

What was required, speakers concurred, was more targeted initiatives by both least developed countries and their international commercial partners and other stakeholders to implement measures that would overcome institutional gaps and create appropriate incentives for more effective international collaboration to exploit investment opportunities, capitalize on unexploited trade opportunities, and assure more efficient and business-enabling knowledge sharing, especially best practices and other types of know-how, including the transfer of appropriate technologies.
