The State party supplements its previous observations by explaining the basis for the dismissal by the domestic court of the complainant’s appeal, namely that the circumstances that led to his departure from his country of origin and to the flight of his wife and children to Angola have already been the subject of a ruling by the Refugee Appeals Board and that the new evidence provided by the complainant has been found wanting and does not invalidate the Board’s analysis.

It follows that a State will not be able to rely on such a reservation and, unless its contrary intention is incontrovertibly established, will remain a party to the treaty without the benefit of the reservation (emphasis added).

The CFA ruled that the presumption against reclamation in the PHO can only be rebutted by establishing an overriding public need for reclamation (the “Overriding Public Need Test”), and that there must be cogent and convincing materials available to enable the decision-maker to be satisfied that the test is fulfilled for rebutting the presumption against reclamation.

However, now that the relevance of the mainstream news media is being challenged by the rising popularity of alternative sources, news distribution platforms are rapidly multiplying and diversifying and social media tools are revolutionizing the way in which people access and share information, the Committee wonders whether the time has come for the Department of Public Information to assess how it can enhance the responsiveness of its public information activities to the Organization’s needs, how it can bring greater creativity and innovation to its work, and how it can continue to promote the work of the United Nations in a way that is more relevant to the daily lives of individuals all around the world.

The inordinate length of translation times, especially in cases of selfrepresented appellants, calls for greater explanation than suitable for a report of this size, but it can be said that efforts are under way to more effectively liaise with the supervisors in the Conference and Language Services Section on a continual basis in order to assess progress and determine the need for requesting prioritization of specific translations, and to readdress the internal requirement of the Conference and Language Services Section that the revision process for translation of a judgement must be accomplished as a whole, rather than volume by volume (which would allow for gradual release of translated portions).

A range of other suggestions was put forward, such as: to ensure the preservation of digital heritage, including archives and libraries as a component of the “Memory of the World Programme”; to develop media education programmes for children and adults; and to increase familiarity with the use of ICTs, especially within the framework of the knowledge society and knowledge economy, in light of the outcomes of the World Summit on the Information Society.

The Republic of Azerbaijan has repeatedly stated that, despite ongoing political efforts towards the earliest resolution of the conflict on the basis of the generally accepted norms and principles of international law, the policy and practice of the Republic of Armenia, the occupying Power, implemented inter alia through various illegal activities in the occupied territories of Azerbaijan, clearly testify to its intention to secure the annexation of these territories (see, for example, the most recent document circulated by Azerbaijan: A/64/760-S/2010/211).
