At its sixty-first session, under the current item, the General Assembly urged all Member States to reject any denial of the Holocaust as a historical event (resolution 61/255).

The five factors with the most potential to cause slippage in projected estimates for completion of judgements on appeal are the delays associated with or caused by: (a) the nature of multi-appellant cases; (b) the inordinate amount of pre-appeal motions; (c) the inordinate length of time for translation of trial judgements into Bosnian/Croatian/ Serbian, as well as for translation of written submissions into one of the Tribunal’s working languages and Bosnian/Croatian/Serbian, especially in cases of selfrepresented appellants; (d) amendments to grounds of appeal, especially following translation of the trial judgement (mainly for represented appellants); and (e) understaffing and/or lack of experience in appeals support.

As the Council’s meeting addresses the issue of nuclear-weapon-free zones, NAM reaffirms the need for the speedy establishment of a nuclear-weapon-free zone in the Middle East in accordance with Security Council resolution 487 (1981) and paragraph 14 of Council resolution 687 (1991) and the relevant General Assembly resolutions adopted by consensus; and, pending its establishment, NAM demands that Israel, the only country in the region that has not joined the Treaty on the Non-Proliferation of Nuclear Weapons or declared its intention to do so, renounce possession of nuclear weapons, accede to the Treaty without further delay, place promptly all its nuclear facilities under International Atomic Energy Agency fullscope safeguards according to Security Council resolution 487 (1981) and conduct its nuclear-related activities in conformity with the non-proliferation regime.

The author stresses that the temporary suspension injunction and the urgent application for the protection of a fundamental freedom were found to be admissible but were rejected by the Council of State, whereas the application on the merits was found to be inadmissible, even though consistent jurisprudence has held that the stages of a competitive examination, such as the “qualification” stage, involve decisions and not preliminary acts and that it should therefore be possible to contest them at any time during the examination without it being necessary to await the publication of the final results on qualification.

The Security Council is meeting on the eve of a historic moment, which must lead us to make an incontrovertible reality of a Palestinian State that is recognized and fully welcomed into the fold of this Organization, thereby finally implementing all the provisions of General Assembly resolution 181 (II), which calls specifically for the creation of two States in Palestinian land — one Arab, the other Jewish.
