Least developed countries have been unable to overcome their economic vulnerability and structurally transform their economies or build resilience against internal and external shocks and crisis.

Based on the above review of the impact of exchange rate fluctuations on peacekeeping budgets, highlighting that approximately 10 per cent of the peacekeeping operations expenditures were in currencies other than the United States dollar in 2009/10 and 2010/11, and that over time the variation on exchange rate had limited impact overall on the accounts of peacekeeping operations, while taking into consideration the pros and the cons of the various options explored to mitigate the risk, as indicated in the first performance report (A/65/589), the Secretary-General is of the view that expected return from the various options set out above would be offset by the actual cost generated and opportunity cost it would represent for missions as well as Member States.

A number of specific comments were made as follows: the concept of food safety is universal, thus there should be no exception, as presently in Article 4.2, allowing exporting countries to export food, which does not comply with its national legislation; the issue of implementation of the Code, especially by countries lacking a control system, should be clarified; the present text may contradict some of the principles of Codex insofar as they establish and draw upon national regulatory frameworks; the ethics of equal treatment in terms of commercial transactions and food aid and donations should be made clearer; and some of the provisions in the text may be contrary to WTO provisions.

When the Group’s share of losses in a jointly controlled entity equals or exceeds its interest in the jointly controlled entity, including any other unsecured receivables, the Group does not recognise further losses, unless it has incurred obligations or made payments on behalf of the jointly controlled entity.

When UNOCI personnel are not present, however, there is no police or customs presence and, as the Group indicated in its midterm report (see S/2010/179, para. 102), suspicious flights remain unrecorded.

Interviews with detainees confirmed that they were brought before the health care professionals, although this might not be for several hours or even days after their arrival.

Subsequent to initial recognition, loans and receivables (including trade and other receivables, deposit paid for acquisition of a subsidiary, pledged bank deposits and bank balances and cash) are carried at amortised cost using the effective interest method, less any identified impairment losses (see accounting policy on impairment loss on financial assets below).

The Security Council also decided that none of the obligations set forth in resolution 1540 (2004) should be interpreted so as to conflict with or alter the rights and obligations of States parties to the Treaty on the Non-Proliferation of Nuclear Weapons, the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction (Chemical Weapons Convention) and the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxin Weapons and on Their Destruction (Biological Weapons Convention), or alter the responsibilities of the International Atomic Energy Agency (IAEA) or the Organization for the Prohibition of Chemical Weapons (OPCW).

Taking into account its recommendations in the paragraphs above, the Advisory Committee recommends the appropriation of an additional amount of $1,571,800 comprising $1,358,700 under section 28C (Office of Human Resources Management), $147,300 under section 28D (Office of Central Support Services), and $65,800 under section 36 (Staff assessment) to be offset by a corresponding amount under income section 1 (Income from staff assessment) of the programme budget for the 2010–2011.

(e) The Review Conference reaffirm the fundamental principle of compatibility contained in the United Nations Convention on the Law of the Sea and set out in article 7 of the Agreement, with specific reference to the high seas and the necessity of not applying measures in the high seas that might undermine the efficacy of the measures applied to straddling fish stocks and highly migratory fish stocks by the coastal State.

Subject to Section 165 of the Ordinance, if any Director or other person shall become personally liable for the payment of any sum primarily due from the Company, the Directors may execute or cause to be executed any mortgage, charge, or security over or affecting the whole or any part of the assets of the Company by way of indemnity to secure the Director or person so becoming liable as aforesaid from any loss in respect of such liability.

Pursuant to the provision equivalent to art. 21 (1)(e) of the Model Law, the court entrusted the administration and realisation of all of the debtor’s assets in Australia to the foreign representatives, ordered that no person could enforce a charge on the property of the debtor and that a pledge or lienholder in possession of the property of the debtor could continue in possession, but could not sell or otherwise enforce the lien or pledge.

Operating expenses increased, though to a lesser extent than revenues, due to higher systems implementation and processing costs and wage inflation, partly offset by reduced average staff numbers as we continued to implement programmes to improve efficiency across our operations.

(e) The net estimated staff assessment income of 30,474,500 dollars, comprising the amount of 29,685,000 dollars for the financial period from 1 July 2011 to 30 June 2012 and the increase of 789,500 dollars in respect of the financial period ended 30 June 2010, to be set off against the balance referred to in subparagraph (d) above, to be prorated among the budgets of the individual active peacekeeping operations.
