In accordance with rule 50 of the rules of procedure of the Council, invoked to implement a no-action motion, the representatives of Qatar and Pakistan spoke in favour of the no-action motion on the call for action by the representative of the United States, and the representatives of the United Kingdom and Romania spoke against the motion.

The effect of these objections seems, however, to have been mitigated a posteriori by the United Kingdom’s declaration of 5 June 1987, which constitutes in a sense the partial withdrawal of its earlier objection (see draft guideline 2.7.7 and the commentary thereon (Official Records of the General Assembly, Sixty-third Session, Supplement No. 10 (A/63/10), pp. 237–240), since the author does not oppose the entry into force of the Convention as between the United Kingdom and a State that has made a reservation to article 66 or to the annex to the Vienna Convention and excludes only the application of Part V in their treaty relations.

In situations of armed conflict, individuals who desire to assemble and associate freely, even to address emergency needs or to call for the end of violence, may meet drastic restrictions that may amount to a strict denial of their rights.

The State party therefore contends that it must be considered incompatible with the founding principles of the Covenant if the Covenant were to be interpreted as imposing a positive duty of action on the State to intervene in a debate on a current topic which has been raised by Parliament and the press unless it advocates national, racial or religious hatred or constitutes an incitement to discrimination, hostility or violence.

In the specific case of prisons, various cultural factors such as ideas that inmates are ―outside society‖ or that they are ―dangerous‖ people and the reactions of the media to public insecurity, contribute to the neglect and vulnerability of persons serving prison sentences or held in pre-trial detention.

Uncoordinated strategies aimed at coping with forced migration caused by sealevel rise may create social and political tensions, which may derail efforts in peacebuilding and post-conflict stabilization and become a threat to international peace and security, as outlined in the report of the Secretary-General (A/64/350).

While the report does not constitute a global analysis of the economic and social situation of indigenous peoples around the world, of the environmental issues confronting them, or of the concept and practices of free, prior and informed consent, it provides information on the consideration and implementation of those at the international and national levels.

During 2001–2007 the activities within the implementation of the DOTS Strategy have been repeatedly evaluated by external missions: tuberculosis experts from the World Bank, experts from the European Regional Bureau of the WHO from Copenhagen and the “Green Line Committee” of the WHO.

Increasingly, ODA and other funding are performance- or results-based; therefore, monitoring of results constitutes a key tool for decision-making.

Consideration would be given to a separate assessment of the contributions of member countries or to voluntary contributions to these statutory bodies.

Regulatory licensing requirements are not limited to just the physical characteristics of the final release product, which ultimately define quality control specifications, but must also cover raw material characteristics and include information derived from forced degradation and accelerated lifetime studies, in order to accommodate future improvements to the end product, the delivery system, and/or the manufacturing process.

Responding to this concern, representatives from the copyright-based industries point to the special initiatives they are undertaking for developing countries, such as donation schemes and low price “budget” editions of books and computer programmes for cost-sensitive users, as the way forward rather than any weakening of international copyright rules and/or enforcement measures in the developing world.

During their visit, the Working Group found that the challenges faced by people of African descent in Portugal related mainly to their lack of recognition as a specific group in the national policy and legal framework; the lack of recognition of their positive contribution throughout history to the construction and development of the country; the lack of qualitative and quantitative disaggregated data by racial or ethnic origin; the existence of a circle of poverty, unequal access to education, public services, employment, as well as discrimination in the administration and functioning of the justice system; existence of racial profiling and police violence; underrepresentation in political and institutional decision-making processes, as well as the lack of special measures or affirmative action policies in Portugal for people of African descent or other minorities.

One delegate was of the view that, despite improvements, a yet tighter focus on measurable expected outcomes appears desirable and emphasized the need for descriptive indicators to facilitate the assessment of achievements.

A few participants, however pointed to a danger that the term “quality education” tended to become too broad complicating any assessment of outcomes or measurement of results, and that an agreed-to definition was warranted.

We acknowledge that the optimum pace and sequence of trade liberalization depends on the specific circumstances of each country, and that each country will make this decision based on its own evaluation of the costs and benefits.
